APPLICANT REQUESTS THAT:
He receive service credit for 10 years of private Chiropractic medical
practice prior to entering the Air Force.

APPLICANT CONTENDS THAT:
At the time of his commissioning the Department of Defense (DoD) did not
grant credit for his years in practice because Chiropractic medicine was
not recognized based on information gathered from the Chiropractic Health
Care Demonstration Program. In October 2001, the National Defense
Authorization Act (NDAA) authorized permanent chiropractic care benefits.
In support of his request, applicant provided a computer printout. His
complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:
The relevant facts pertaining to this application, extracted from the
applicant’s military records, are contained in the letter prepared by the
appropriate office of the Air Force at Exhibit B.

AIR FORCE EVALUATION:
AFPC/DPAMF2 reviewed applicant's request and recommends denial. DPAMF2
states that he entered active duty on 31 Jul 01, with 7 years and 28 days
constructive service credit, entitling him to enter active duty in the
grade of captain with a date of rank of 2 Jul 98. In accordance with AFI
36-2005, he was awarded constructive service credit based on all qualifying
education and prior service he had at the time he entered the Air Force.
Members are given credit in the corps which assigned. He is assigned to
the Medical Corps (MC). Chiropractic medicine falls under the Biomedical
Service Corps (BSC), under which he is not assigned and therefore, would
not have been given the credit since he is a Family Practice Physician.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 6 Sep
02 for review and comment within 30 days. As of this date, this office has
received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. Evidence has not been provided which
would lead us to believe that the rules of the applicable regulations,
which implement the law, were inappropriately applied or that he was denied
rights to which he was entitled. After reviewing the evidence of record it
appears that his constructive service credit was properly applied and his
grade was appropriately determined upon his entry in the Air Force.
Therefore, we agree with the opinion and recommendation of the Air Force
office of primary responsibility and adopt their rationale as the basis for
our conclusion that the applicant has not been the victim of an error or
injustice. In the absence of persuasive evidence to the contrary, we find
no basis to recommend granting the relief sought in this application.

The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
