APPLICANT REQUESTS THAT:
He be considered for promotion to lieutenant colonel by special
selection board (SSB) for the Calendar Year 2001B (CY01) Lieutenant
Colonel Selection Board (5 Nov 01).

APPLICANT CONTENDS THAT:
Due to an oversight by the unit he was assigned to from Jul 97 to
Aug 00, the Meritorious Service Medal (MSM), First Oak Leaf Cluster
(1OLC) he was awarded was processed late and was not included in
his Officer Selection Record (OSR) or on his Officer Selection
Brief. He believes that the lack of a decoration in his record for
this period was a major factor in his nonselection for promotion.
Applicant also provides a letter of support from his commander at
the time verifying the unit’s error in not processing an award on
the applicant in time for his promotion board. The commander
requests that the applicant be considered for promotion by SSB.

STATEMENT OF FACTS:
The applicant is presently serving on active duty in the grade of
major. His Total Active Federal Military Service Date (TAFMSD) is
28 May 86. He was considered and not selected for promotion to
lieutenant colonel by the CY01B Lt Col Selection Board. A review
of his last ten Officer Performance Reports (OPRs) indicates
overall ratings of “meets standards.”

AIR FORCE EVALUATION:
AFPC/DPPPO recommends denial of the applicant’s request.
Applicant’s decoration was not approved until after the promotion
board results were announced. There is no clear evidence that the
lack of a citation negatively impacted his promotion opportunity.
Central boards evaluate the entire OSR, assessing whole person
factors such as job performance, professional qualities, depth and
breadth of experience, leadership, and academic and professional
military education. The selection board had his entire officer
selection record that clearly outlined his accomplishments while
assigned to the unit that he eventually received the decoration
from.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant
on 9 Jul 02 for review and comment within 30 days. To date, a
response has not been received.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. After reviewing the complete
evidence of record, we find no evidence to support that there was
intent to submit the applicant for an award during the time of his
reassignment. The Board notes that when an individual is selected for
reassignment, the personnel data system requires the losing unit to
indicate if the individual will be submitted for an award. The
applicant has failed to provide documentation showing that he was
recommended for an award at that time. The statement from the
commander is noted; however, in the absence of official documentation
showing that he was recommended for the MSM in August 2000, we find no
compelling basis to recommend granting the relief sought in this
application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.

In support of his request, applicant provided his MSM citation and special order GB-18. DPPPO states that although the period of award for the decoration was through 17 Jul 01, the orders for the decoration were not published until 9 Nov 01. Thus, it is our opinion that the MSM was not a matter of record at the time the selection board convened and accordingly, it was not required to be included in his selection record.
In support of his request, applicant provided his MSM citation and special order GB-18. DPPPO states that although the period of award for the decoration was through 17 Jul 01, the orders for the decoration were not published until 9 Nov 01. Thus, it is our opinion that the MSM was not a matter of record at the time the selection board convened and accordingly, it was not required to be included in his selection record.
