APPLICANT REQUESTS THAT:

The duty title for the Officer Preselection Brief  and  the  Promotion
Recommendation Form  reviewed  by  the  Calendar  Year  1998A  (CY98A)
Central Colonel Selection Board should be changed to “Dental Residency
Flight Commander,” and he be given promotion consideration by  Special
Selection Board (SSB).

APPLICANT CONTENDS THAT:

In August, it came to his attention that all other Advanced  Education
in General Dentistry Program (AEGD) Residency  directors  meeting  the
1998 colonel promotion board had the duty title  of  Dental  Residency
Flight Commander (the correct Objective Medical Group duty  title  for
AEGD program director) and were all promoted to colonel.  He  was  not
aware of his incorrect duty title until recently, and to his knowledge
was the only Dental Residency director with the duty title,  Director,
AEGD Program, rather than Dental Residency Flight Commander.

STATEMENT OF FACTS:

The applicant is currently serving on  extended  active  duty  in  the
grade of lieutenant colonel.

Applicant was considered and not selected for promotion to  the  grade
of colonel by the CY98A (9 Nov 98), CY99A (8 Nov 99), CY00A (6 Nov 00)
central colonel selection boards. He was also considered by the  CY01A
board; however, the results are not releasable at this time.

AIR FORCE EVALUATION:

AFPC/DPMAF2 recommends denial of applicant's request.  The applicant’s
Officer Performance Report (OPR), closing out 1 Mar 99, is the  source
document for the duty title used for the 1998 Colonel Promotion Board.
 This OPR states his duty title as “Director,  Advanced  Education  in
General Dentistry Program.”  Should the applicant  wish  to  pursue  a
correction to this duty  title  for  the  above  referenced  promotion
board, he must submit a request for correction to his OPR.  With  that
in mind, the applicant’s rater on this OPR signed with the duty  title
“Dental Residency Flight Commander.”  In order for  the  applicant  to
request correction to this OPR, the applicant’s rater on that OPR must
have his duty information corrected first since both  officers  cannot
hold the same duty title during the same period.

A complete copy of the evaluation is attached at Exhibit C.

AFPC/DPPP recommends denial of this appeal.  The applicant states  “he
was not aware of his incorrect duty title until  recently.”   However,
the duty title appeared on his 12 Jun 98 OPR, made a matter of  record
24 Jul 98, over 3 months before the central selection board (CSB).  He
received his PRF copy on or about    21 Oct 98,  19  days  before  the
CSB.  Each officer is also provided  an  officer  pre-selection  brief
approximately 105 days before the board with detailed explanations for
correcting data before the board convenes.  The  applicant  had  ample
opportunity to discover and prove an inaccuracy in his duty title well
before the CSB.  He did not do so then, and has  still  not  done  so.
Based on the 12 Jun 98 OPR, the source document from the time the  PRF
was authored, the duty title on his PRF was accurate.   The  applicant
provides no supporting documentation from his  senior  rater  for  the
requested action.   He  does  not  state  what  corrective  action  he
accomplished prior to board convening.

AFPC/DPPPO  recommended  denial.   The  application  is  timely.   The
applicant has three nonselections to  the  grade  of  colonel  by  the
M0698A, M0699A, and M0600A central boards.   The  applicant  was  also
considered by the CY01A (22 Oct 01) (M0601A) colonel board.   However,
the results from the board are  not  releasable  at  this  time.   The
governing directive is AFI 36-2501, Officer Promotions  and  Selective
Continuation, 6 Mar 98.  They concur  with  the  findings  in  the  HQ
AFPC/DPAMF2 and HQ AFPC/DPPPA advisories, and have nothing further  to
add.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

Complete copies of the Air Force evaluations  were  forwarded  to  the
applicant on 30 Nov 01, for review and response.  As of this date,  no
response has been received by this office.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was timely filed.

3.    Insufficient relevant evidence has been presented to demonstrate
the existence  of  probable  error  or  injustice.   After  thoroughly
reviewing the applicant’s submission, which did not contain any rating
chain support, we are not persuaded that  his  duty  title  should  be
changed to “Dental Residency Flight Commander” as requested.  We  note
that his officer selection brief  revealed  that  his  duty  title  of
“Director,  Advanced   Education   in   General   Dentistry   Program”
corresponded with the OPR rendered during the contested  time  period.
During the contested period, the applicant’s rater’s  duty  title  was
documented as “Dental Residency  Flight  Commander.”   Therefore,  the
applicant has not established that the  duty  title  is  incorrect  or
either the selection brief or the PFE.  Therefore, after reviewing the
evidence of record, we agree with the opinion  and  recommendation  of
the Air  Force  and  adopt  their  rationale  as  the  basis  for  our
conclusion that the applicant has not been the victim of an  error  or
injustice.  In view of the foregoing and in the absence of evidence to
the contrary, we find no compelling basis to  recommend  granting  the
relief sought in this application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of probable  material  error  or  injustice;
that the application was denied without  a  personal  appearance;  and
that the application will only be reconsidered upon the submission  of
newly  discovered  relevant  evidence   not   considered   with   this
application.
