APPLICANT REQUESTS THAT:
His duty title be corrected on his Officer Selection Brief (OSB) and he be
considered for promotion to the grade of colonel by a Special Selection
Board (SSB) for the CY01A (22 October 2001) Colonel (Dental Corps) Central
Selection Board (M0601A).

APPLICANT CONTENDS THAT:
He is the Chief of Oral and Maxillofacial Surgery at Sheppard AFB, TX which
reflects a job progression through his career beginning after graduation
from residency as Assistant Chief at a Regional Medical Center followed by
Chief at the hospital level and currently as Chief of Oral and
Maxillofacial Surgery at the medical center level and AEGD Residency
Training Program. This omission may have had a significant impact on the
board’s decision to promote him. He realizes that the responsibility to
insure the records are correct resides with him; however, he was never
offered the opportunity to review the OSB prior to the board convening.
His MPF could not supply him with the AZMET copy for his review until 30
April 2002.
In support of his application, he provides a personal statement, supporting
statement from his commander, copy of his OSB and a print-out of his
personal history.

STATEMENT OF FACTS:
Information extracted from the Personnel Data System (PDS) indicates the
applicant’s Total Active Federal Military Service Date as 2 July 1982. He
is currently serving on active duty in the grade of lieutenant colonel,
with a date of rank of 4 June 1994.
The applicant’s OSB contains AF Forms 707B, Officer Performance Reports
(OPRs) beginning with the rating period 1 July 1995 and ending on 1 May
2002 with overall ratings of “Meets Standards.” The applicant received two
AF Forms 475, Education/Training Records, documenting his completion of
Advanced Residency Training in Oral and Maxillofacial Surgery third and
fourth year, for the period 1 July 1993 through 30 June 1994 and 1 July
1994 through 30 June 1995 respectively.
He was considered and not selected for promotion to the grade of colonel by
the CY01A colonel (dental corps) central selection board, which convened on
22 October 2001.
In February 2000, the applicant submitted an application to the Board
requesting that his academic degrees be considered for promotion to the
grade of colonel by an SSB for the CY1999A Colonel (Dental Corps) Central
Selection Board. The Board granted his request. In August 2000 he met an
SSB and was a nonselect.

AIR FORCE EVALUATION:
AFPC/DPPPO recommends the application be denied. DPPPO states that
eligible officers are provided an Officer Preselection Brief (OPB)
approximately 100 days prior to board convening date. Along with the OPB,
members are provided an instruction sheet that outlines how to correct
discrepancies prior to the start of a promotion board. The applicant
received an OPB and the instruction sheet in July 2001. He has not
provided any information regarding what action he took prior to the board
convening to ensure his duty title was correct. The selection board had
his entire officer selection record that clearly outlined his
accomplishments since the date he came on active duty. Since he has not
demonstrated “reasonable diligence” in the maintenance of his records,
DPPPO does not support promotion reconsideration on this issue.

AFPC/DPAMF2 states that the applicant’s duty history has since been
corrected to replace the “Oral Surgeon” duty title with “Chief, Oral
Maxillofacial Surgery.” The AFPC/DPAMF2 evaluation is at Exhibit D.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
Copies of the Air Force evaluations were forwarded to the applicant on 20
December 2002 for review and response. As of this date, this office has
received no response (Exhibit E).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We have reviewed the available evidence
pertaining to the applicant’s assertions related to his duty title on the
OSB for the CY 2001A Colonel (Dental Corps) Central Selection Board,
including a statement from his commander, and we are unpersuaded that SSB
consideration based on a change to his duty history is warranted. His
contentions in this regard are duly noted; however, in our opinion, the Air
Force office of primary responsibility has adequately addressed these
contentions and we are in agreement with their assessment of his case.
Accordingly, in the absence of documentation showing what action he took
prior to the board convening which demonstrates “reasonable diligence” in
the maintenance of his records, SSB consideration based on this issue is
not appropriate. Accordingly, in the absence of evidence which would lead
us to believe his record was so inaccurate and misleading that the duly
constituted board, charged with the discretionary authority to select
officers for promotion, was unable to make a reasonable judgment concerning
his promotability in relation to his peers, the applicant’s request is not
favorably considered.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
