APPLICANT REQUESTS THAT:
The six-year Active Duty Service Commitment (ADSC) he received for
completion of Undergraduate Navigator Training (UNT) be reduced to
four years.

APPLICANT CONTENDS THAT:
His six-year UNT ADSC is incorrect because Air Force Instruction
(AFI) 36-2107, Active Duty Service Commitments (ADSC) and Specified
Period of Time Contracts (SPTC), dated 1 September 1998, Table 1.4,
Note 3b, states, “Individuals graduating from military service
academies and AFROTC programs on 1 January 1992 or later incur a 5-
year and 4-year ADSC respectively.”
Applicant’s complete statement and documentary evidence submitted
in support of his application are included as Exhibit A, with
Attachments 1 and 2.

STATEMENT OF FACTS:
Applicant completed UNT on 14 January 1997. His UNT ADSC was
prescribed by the 6 July 1994 version of AFI 36-2107, which was in
effect at the time he completed UNT. In accordance with that
version, Table 1.4, Rule 2, he incurred a 6-year ADSC.
AFI 36-2107 (dated 1 September 1998), Table l.4, Note 3b, was
erroneous and subsequently amended by Interim Change 99-1, dated
23 December 1999. Specifically, the Interim Change corrected the
ADSC for UNT to 6 years. This version of AFI 36-2107, however, was
not in effect when the applicant graduated from UNT.

AIR FORCE EVALUATION:
AFPC/DPSFO recommends denial stating that the applicant states he
was informed the ADSC for UNT was changed to six years when he
graduated. They have researched historical data on UNT ADSCs and
found the ADSC has been 6 years since 1989. While it is true that
AFI 36-2107 (dated 1 September 1998), Table l.4, Note 3b, cited a 4-
year ADSC, this information was erroneous and subsequently amended
by Interim Change 99-1 dated 23 December 1999.
The applicant acknowledged and accepted the correct 6-year ADSC
when he signed and initialed an AF Form 1056, Air Force Reserve
Officer Training Corps Contract, on 9 September 1993 (Atch 2). In
addition, he makes no claim that he was improperly or incorrectly
advised of the ADSC he incurred for completion of UNT. In fact, he
claims, “I was told by all agencies that a 6-year ADSC was incurred
for UNT.” He simply believes there is an error with his ADSC based
upon erroneous guidance in the 1998 version of AFI 36-2107
(Exhibit C, with Attachments 1 and 2).

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the advisory opinion was made available to the applicant
for review and comment in accordance with established policy on
15 June 2001 (Exhibit D); however, to date, he has failed to
respond.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of either an error or an injustice
warranting favorable action on the applicant’s request. His
contention is duly noted. However, we do not find his
uncorroborated assertion, in and by itself, sufficiently persuasive
to override the rationale of the Air Force evaluation. Therefore,
we agree with the recommendation of the Air Force and adopt its
rationale as the basis for our decision.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of probable material error or injustice;
that the application was denied without a personal appearance; and
that the application will only be reconsidered upon the submission
of newly discovered relevant evidence not considered with this
application.
