APPLICANT REQUESTS THAT:
Applicant makes the following requests on two separate applications:
A. The Officer Performance Report (OPR) rendered on him for
the period of 6 Mar 97 through 5 Mar 98 be revised.
B. The OPR rendered on him for the period 6 Mar 99 through 8
Oct 99 be revised.
In a memorandum dated 26 Feb 01, the applicant amended his original
applications to also request promotion consideration to lieutenant
colonel by special selection board (SSB) for the Calendar Year (CY) 99B
Lieutenant Colonel Central Selection Board.

APPLICANT CONTENDS THAT:
Due to confusion and oversights on appropriate professional military
education (PME) endorsements by his Rater, Additional Rater, and
Reviewer on the OPR rendered on him for the period 6 Mar 97 through 5
Mar 98, his Reviewer is requesting that the report be revised to
correct PME recommendations and job performance information. In
support of his appeal, the applicant provided a letter of support from
his Reviewer.
The Additional Rater on the OPR rendered on him for the period 6 Mar 99
through 8 Oct 99 was confused on appropriate information and verbiage
to use in that section regarding an assignment recommendation. In
support of his appeal, the applicant provided letters of support from
his Additional rater and Reviewer.

STATEMENT OF FACTS:
The applicant is presently serving on active duty in the grade of
major. His Total Active Federal Military Service Date is 5 Jan 84.
He was considered and not selected for promotion to lieutenant colonel
by the CY99B Lieutenant Colonel Selection Board. On 6 Dec 00, the
Evaluation Reports Appeal Board (ERAB) partially approved an appeal by
the applicant that included the request for changes to his OPRs closing
out 5 Mar 98 and 8 Oct 99. The ERAB approved the applicant’s request
to substitute his promotion recommendation form (PRF) for the CY99B
Lieutenant Colonel Selection Board and to change the Duty Air Force
Specialty Code (DAFSC) on an OPR closing out 5 Mar 99. He was also
granted promotion consideration by SSB for the CY99B Lieutenant Colonel
Selection Board. They denied the changes to the OPRs that the
applicant now makes in his appeal to the AFBCMR.

AIR FORCE EVALUATION:
The Chief, Performance Evaluation Section, AFPC/DPPPE, evaluated the
applicant’s request to have the PME endorsements in the OPR rendered on
him for the period 6 Mar 97 through 5 Mar 98 revised. They recommend
approval of the applicant’s request.
Applicant has substantiated his claim that an inappropriate PME
recommendation was made on his OPR. Unfortunately, he was unable to
obtain evaluator support to change the PME recommendation due to the
retirement of both rater and additional rater. Applicant did receive
approval of a similar appeal from the ERAB concerning his OPR that
closed out 5 Mar 99 (applicant had evaluator support). A reasonable
conclusion can be drawn that applicant should have and would have been
recommended for senior service school (SSS) on the report in question;
however, confusion existed as to which PME recommendation was actually
appropriate.

AFPC/DPPPE also evaluated the applicant’s request to replace the OPR
covering the period 6 Mar 99 through 8 Oct 99. They recommend denial
of this request.
Applicant has not provided any documentation to prove the invalidity of
his 8 Oct 99 OPR. Applicant’s attempt to revise a previous OPR based
on the perceived strength of the evaluator’s comments is inappropriate.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
The applicant responded to the Air Force evaluations by requesting to
amend his original application to include promotion consideration by
SSB should his application be approved.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate
the existence of probable error or injustice. The Board accepts
the recommendation of the Air Force to correct the applicant’s OPR
closing out 5 Mar 98. The Board does not agree, however, with the
recommendation to deny the applicant’s request to correct his OPR
closing out 8 Oct 99. The Board notes that the applicant has the
support of his Additional Rater and Reviewer to make the requested
change to this OPR. The Board believes that the phrase “compete
for command” is incorrect, as was the PME recommendation, and that
these errors may have negatively impacted the applicant’s promotion
opportunity. While this is certainly not conclusive, the Board
believes that the benefit of the doubt should be given to the
applicant. Therefore, the Board recommends that the record be
corrected as indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that:
a. The Officer Performance Report, AF Form 707A, rendered
for the period 6 March 1997 through 5 March 1998 be amended in
Section VI, “Rater Overall Assessment”, line nine, and in section
VII, “Additional Rater Overall Assessment”, line five, by changing
“ISS” to “SSS.”
b. The Officer Performance Report, AF Form 707A, rendered
for the period 6 March 1999 through 8 October 1999 be amended in
Section VII, “Additional Rater Overall Assessment”, line five, by
changing “compete” to “select.”
It is further recommended that he be considered for promotion to
the grade of lieutenant colonel by Special Selection Board (SSB)
beginning with the CY99B Central Lieutenant Colonel Selection Board
and any subsequent boards to which entitled with the corrected
record

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the
authority of Section 1552, Title 10, United States Code (70A Stat
116), it is directed that:
The pertinent military records of the Department of the Air
Force relating to XXXXXXXXXXX, XXX-XX-XXXX, be corrected to show
that:
a. The Officer Performance Report, AF Form 707A,
rendered for the period 6 March 1997 through 5 March 1998 be, and
hereby is, amended in Section VI, “Rater Overall Assessment”, line
nine, and in Section VII, “Additional Rater Overall Assessment”,
line five, by changing “ISS” to “SSS.”
b. The Officer Performance Report, AF Form 707A,
rendered for the period 6 March 1999 through 8 October 1999 be, and
hereby is, amended in Section VII, “Additional Rater Overall
Assessment”, line five, by changing “compete” to “select.”
It is further directed that he be considered for promotion to
the grade of lieutenant colonel by Special Selection Board (SSB) by
the CY99B Central Lieutenant Colonel Selection Board and any
subsequent boards that the OPRs as corrected above were not a
matter of record.

Based on these statements, we recommend that the duty title be corrected. In his appeal to this Board, applicant has requested that he be considered for ISS, which is the appropriate PME recommendation that should have been indicated on the OPR. Therefore, we recommend the duty title and PME recommendation be changed on the contested OPR and that his corrected report be considered for promotion and ISS by SSBs.

The rater and additional rater of the contested OPR provide statements contending that the correct PME level on the report should have been for SSS rather than ISS. The OPR closing 23 Jun 97 recommends SSS in residence. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice to warrant altering the 23 Jun 96 OPR to reflect a PME recommendation of “SSS” rather than “ISS” and granting SSB consideration for the CY99A selection board.
The applicant states that the Evaluation Reports Appeal Board (ERAB) rejected a similar request because the time to change a report is before it becomes a matter of record. Willingness by an evaluator to include different, but previously known information, is not a valid basis for doing so. The applicant contends the absence of PME recommendations on the contested report sent a negative message to the selection board to not promote him.
