APPLICANT REQUESTS THAT:
He receive satisfactory Federal service credit for the time that he served
in the California Air National Guard from October 1956 to June 1958.

The reasons the applicant believes the records to be in error or unjust and
the evidence submitted in support of the appeal are at Exhibit A.

STATEMENT OF FACTS:
The relevant facts pertaining to this application, extracted from the
applicant's available military records, are contained in the letter
prepared by the appropriate Air Force office of primary responsibility
(OPR). Accordingly, there is no need to recite these facts in this Record
of Proceedings.

AIR FORCE EVALUATION:
The Director of Personnel Program Management, HQ ARPC/DPP, reviewed the
application and states that the applicant enlisted in the California Air
National Guard (CAANG) on 14 March 1956 and remained with the unit until 8
June 1958. He was then transferred to the Inactive Reserve Section (IRS)
until discharged on 16 August 1959. The applicant’s Master Personnel
Records (MPR) were destroyed in the 1972 [1973] fire at the National
Archive and Records Administration in St. Louis, Missouri. Documents
showing the applicant’s name were found, showing participation was a fact,
but not the amount of points except active duty.
A complete copy of the Air Force evaluation is attached at Exhibit C.

APPLICANT'S REVIEW OF AIR STAFF EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 19
July 1999 for review and response. Applicant did respond to the Air Force
evaluation on 21 July 1999 however, he has not submitted additional
documentation.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of probable error or injustice warranting partial relief. It
appears that a portion of applicant’s records were destroyed in a fire at
the National Personnel Records Center in St. Louis, Missouri in 1973.
However, the documentation obtained reflects that the applicant
participated in the California Air National Guard (CAANG). Although the
applicant is requesting retirement points for the period October 1956 to
June 1958, it appears that his retirement/retention (R/R) year began 14
March and ended 13 March. His record shows that he earned a total of 88
points during R/R year ending 13 March 1957; therefore, it appears he was
awarded points for that time period. His record reflects he was promoted
in October 1957 further indicating his participation during the period 14
March 1957 through 13 March 1958; however, his record shows that he did not
earn sufficient points for a satisfactory year for retirement. We believe
that, based upon this promotion, his records would have shown that he
participated and earned sufficient points to reflect a satisfactory year of
Federal service. Therefore, we recommend his records be so corrected.
Applicant’s request for points through June 1958 was duly noted; however,
we note that his records reflect he earned a total of 25 retirement points
through June 1958 when he was transferred to the Obligated Reserve Section.
We find insufficient evidence to show that he would have earned more than
the 25 points for which he was credited during the period 13 March 1958
through 8 June 1958.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT, be corrected to show that he was credited with an additional
20 non-paid Inactive Duty Training (IDT) points during the
retirement/retention year 14 March 1957 through 13 March 1958, resulting in
50 total points; and, that the period 14 March 1957 through 13 March 1958
is a year of satisfactory Federal service for retirement.

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:
The pertinent military records of the Department of the Air Force
relating to be corrected to show that he was credited with an
additional 20 non-paid Inactive Duty Training (IDT) points during the
retirement/retention year 14 March 1957 through 13 March 1958, resulting in
50 total points; and, that the period 14 March 1957 through 13 March 1958
is a year of satisfactory Federal service for retirement.

According to HQ ARPC/DPP, he has 43 points for R/R Mar 99-Mar 00; 50 points are needed for a satisfactory year. The applicant did complete the F/Y 99 requirement of 12 active duty (AD) points and 48 IDT by participating for 10 points during Sep 99; however, these points were actually the first points earned for his 8 Mar-7 Mar 00 R/R year. Before his R/R date was ever changed, he had completed all training day and active duty requirements, based on the information he had at the time, by Feb 99.
The appropriate Air Force office evaluated applicant's request and provided an advisory opinion to the Board recommending the application be denied (Exhibit C).
