APPLICANT REQUESTS THAT:
His nonselections for promotion by the FY00 and FY01 Major Selection Boards
be voided and he receive Special Selection Board (SSB) consideration; he be
continued in the Reserve program until the SSB decision is made; and, his
Total Federal Commissioned Service Date (TFCSD) be adjusted.

STATEMENT OF FACTS:
Applicant was considered and not selected for promotion to the grade of
major by the FY00 and FY01 Reserve of the Air Force Line and Nonline Major
Selection Boards which convened in March 1999 and March 2000, respectively.
On 9 Feb 01, the Board granted partial relief of his request and directed
that his corrected record be considered for promotion to the grade of major
by a Special Selection Board (SSB) for the FY00 and FY01 Reserve of the Air
Force Line and Nonline Majors Selection Boards; and, if not selected for
promotion by either board, that he be considered for continuation by a
Special Review Board (SRB) for the Air Force Reserve Major Selective
Continuation Board, which convened on 6 March 2000. The applicant was not
selected for promotion to the grade of major by the SSB, but was
recommended for selective continuation by the SRB that convened on 22 Oct
01.

THE BOARD CONCLUDES THAT:
Based on the previous corrections to his military records and his
recommendation for selective continuation by the 22 Oct 01 SRB, further
correction to his military record is required. The purpose of continuation
is to retain in an active status, officers who would otherwise be required
to separate due to twice failing to be selected for promotion to the next
higher grade. By law, continuation status for an officer serving in the
grade of captain may not exceed the last day of the month in which 20 years
of commissioned service is completed. In the applicant's case, his
continuation status terminated on 31 Jan 01. Therefore, in order to ensure
that his records accurately reflect his selection for continuation, we
recommend that his records be corrected to the extent below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT be corrected to show that:
a. On 1 December 2000, he was not relieved from his assignment as an
Operations Officer.
b. He be credited with an additional four non-paid inactive duty
training points during the partial retirement/retention year 2 June 2000
through 30 January 2001.
c. On 31 January 2001, he was honorably discharged from all
appointments held in the Air Force Reserve.

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that:
a. On 1 December 2000, he was not relieved from his assignment as an
Operations Officer.
b. He be credited with an additional four non-paid inactive duty
training points during the partial retirement/retention year 2 June 2000
through 30 January 2001.
c. On 31 January 2001, he was honorably discharged from all

If not selected for promotion to the grade of major, he be considered for continuation until the completion of 20 years of service. The applicant was considered and nonselected for promotion to the grade of major by an SSB, which convened on 1 March 1999, for the FY99 Line and Nonline Major Promotion Board. The applicant was notified by letter, 7 January 1999, that SSB consideration had been granted for the FY99 Line and Nonline Major Promotion Board (2 March 1998).

Additionally, because he was considered a two-time passover for promotion to lieutenant colonel, he was notified he would be retired as required by law effective 1 April 2001. He did not complete the training because of his retirement from military service effective 1 April 2001. The particular member was never the applicant’s supervisor and his duties and responsibilities at the time were far- removed from the applicants.
A complete copy of the evaluation is at Exhibit C. The Chief, Officer Promotion & Appointment Branch, HQ AFPC/DPPPO, recommended that, since the applicant is not eligible for active duty promotions, he remain on the RASL and be eligible to compete for Reserve promotion boards.
