APPLICANT REQUESTS THAT:
Her records be corrected to reflect that the retirement year ending
(RYE) 19 Nov 95 was a satisfactory year of Federal service for
retirement.

unjust and the evidence submitted in support of the appeal are at

STATEMENT OF FACTS:
The relevant facts pertaining to this application are contained in the
letter prepared by the appropriate office of the Air Force.
Accordingly, there is no need to recite these facts in this Record of
Proceedings.

AIR STAFF EVALUATION:
ARPC/DPP reviewed this application and recommended denial. A complete
copy of the evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR STAFF EVALUATION:
A copy of the Air Staff evaluation was forwarded to applicant on 10
Sep 99 for review and response. As of this date, no response has been
received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of probable injustice. The evidence of record reveals that
the applicant was one point short of a good retirement year for the
Retirement Year Ending (RYE) 19 Nov 95. While there is no indication
that her points were erroneously credited for this period, after
reviewing the facts and mitigating circumstances involved in this case
and in view of the applicant’s history of active participation, we
believe that it is in the interest of justice to afford the applicant
the relief that would give her the additional one point necessary for
a good retirement year. Accordingly, we recommend that the
applicant’s records be corrected as indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that she was credited with
one (1) additional nonpaid inactive duty point during the
retirement/retention year 20 Nov 94 through 19 Nov 95, resulting in 50
total points; and, that the period 20 Nov 94 through 19 Nov 95 is a
year of satisfactory Federal service for retirement.

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:
The pertinent military records of the Department of the Air
Force relating to , be corrected to show that she was credited with
one (1) additional nonpaid inactive duty point during the
retirement/retention year 20 Nov 94 through 19 Nov 95, resulting in 50
total points; and, that the period 20 Nov 94 through 19 Nov 95 is a
year of satisfactory Federal service for retirement.

According to HQ ARPC/DPP, he has 43 points for R/R Mar 99-Mar 00; 50 points are needed for a satisfactory year. The applicant did complete the F/Y 99 requirement of 12 active duty (AD) points and 48 IDT by participating for 10 points during Sep 99; however, these points were actually the first points earned for his 8 Mar-7 Mar 00 R/R year. Before his R/R date was ever changed, he had completed all training day and active duty requirements, based on the information he had at the time, by Feb 99.

For RYE 29 Dec 93, the applicant did not earn any points from Sep 93 through Dec 93, then after two consecutive satisfactory federal service years, the applicant received another unsatisfactory year, and did not earn points from Sep 96 through Dec 96. On 2 Feb 91, he enlisted in the Washington Air National Guard (ANG); he transferred to the Air Force Reserve on 10 Dec 92. On 19 Feb 95, he was discharged from the Air Force Reserve with a General discharge by reason of Defective Enlistment – Fraudulent Entry. In order to establish eligibility for Reserve retired pay under the provisions of Title 10, United States Code, Section 12731, a member must complete 20 years of satisfactory service with the last 6 years of qualifying service in a Reserve component.
