APPLICANT REQUESTS THAT:
His Reenlistment Eligibility (RE) code of 2X be changed so that he can be
eligible for reenlistment. {Examiner’s Note: RE code 2X denotes First-
term, second-term, or career airman considered but not selected for
reenlistment under the Selective Reenlistment Program (SRP).}

APPLICANT CONTENDS THAT:
His RE code 2X was based on an administrative error due to a training
status issue. He states that changing his RE code to allow him an audition
for reenlistment in the USAF Band of Mid-America can rectify this issue.
In support of his appeal, applicant submitted two letters of recommendation
from the commander of the Air Force Band of the Golden West and the
commander of the Air Force Band of Mid-America.

STATEMENT OF FACTS:
On 01 May 1996, applicant enlisted in the Regular Air Force for a period of
four years. Prior to his discharge, the applicant received two enlisted
performance reports for the periods 1 May 96 - 15 Oct 97 and 16 Oct 97 - 15
Oct 98, with overall promotion recommendations of four and three,
respectively.
On 30 April 2000, the applicant was honorably discharged by reason of
completion of required active service and issued RE Code 2X. Applicant’s
grade at time of discharge was airman first class (E-3). He was credited
with 4 years of active service.
Other relevant facts pertaining to this application, extracted from the
applicant’s military records, are contained in the letter prepared by the
appropriate office of the Air Force. Accordingly, there is no need to
recite these facts in this Record of Proceedings.

AIR FORCE EVALUATION:
On 8 August 2000, the Skills Management Branch, recommended denial of the
applicant’s request for correction of the RE code. In their opinion, the
commander’s action was justified. A review of the applicant’s military
personnel records revealed an AF Form 418, Selective Reenlistment Program
Consideration, dated 13 Jan 99, denying him reenlistment. The records also
reflected that the applicant acknowledged notification of nonselection for
reenlistment and his right to appeal. They found no appeal on file. They
state the applicant was not meeting standards as evidenced by the AF Form
418 and two performance reports. The evaluations reflected “removed from
Upgrade Training… due to lack of progress and motivation,” “disinterest in
promotion or continuation of service resulted in minimum compliance with
Air Force standards of appearance, behavior and respect for his superiors.”

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 2 November 2000, the applicant responded to the Air Force evaluation by
personal letter (Exhibit E).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of probable error or injustice. The applicant’s assigned RE code
of 2X accurately reflects the circumstances at the time of his separation.
Specifically, that he was considered but not selected for reenlistment
under the Selective Reenlistment Program. Nevertheless, after reviewing
the statements submitted in the applicant’s behalf from the Commanders of
the United States Air Force Bands of the Golden West and Mid-America, who
believe the applicant has much to offer the USAF Band career field, we
believe that he should be afforded a second chance. Therefore, as a matter
of clemency, we recommend that the applicant’s RE Code be changed to “3K.”
This is a code that can be waived for prior service consideration, provided
he is otherwise qualified for enlistment under an existing prior service
program.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT be corrected to show that on 30 April 2000, he was discharged
with Reenlistment Eligibility (RE) code “3K.”

Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:
The pertinent military records of the Department of the Air Force
relating to applicant, be corrected to show that on 30 April 2000, he was
discharged with Reenlistment Eligibility (RE) code “3K.”

The supervisor stated that he was unable to select the applicant for reenlistment at the time because the applicant had not demonstrated the desire or capability to accept the additional duties and responsibilities required of a career airman in today’s Air Force. The evidence of record indicates that the applicant was not selected for reenlistment in the Air Force. Furthermore, it now seems that the applicant has the motivation and the desire to commit himself to the service of his country.
