APPLICANT REQUESTS THAT:
He be considered for promotion to the grade of lieutenant colonel by
Special Selection Board (SSB) for the CY99B (30 Nov 99) lieutenant
colonel board with the citations for the Meritorious Service Medal
(MSM) and the Air Force Commendation Medal, Second Oak Leaf Cluster
(AFCM 2OLC), included in his record.

APPLICANT CONTENDS THAT:
His MSM and AFCM 2OLC were cited on his officer selection brief (OSB),
but the citations were omitted from his officer selection record
(OSR). A board discrepancy report was generated because of the
omission in his records. This report generated an inquiry at his
military personnel flight (MPF) prior to the board, but for some
reason no corrective action was taken. In his post-board review the
counselor felt these omissions were most detrimental and may have
incorrectly conveyed apathy on his part. The counselor further
recommended that the applicant file a petition of appeal. He has
since rectified the deficiencies in his records.
In support of his appeal, the applicant provided a copy of the board
discrepancy report, dated 17 Nov 99 (Exhibit A).

STATEMENT OF FACTS:
Applicant is currently serving on active duty in the grade of major,
having been promoted to that grade, effective 01 February 1996.
The applicant was considered but not selected for promotion by the
CY99B lieutenant colonel selection board.
The MSM for the period 25 Aug 93 – 17 Jul 98, was reflected on the OSB
prepared for the CY99B Board. However, the citation was missing from
the applicant’s OSR.
The AFCM 2OLC, for the period 15 Mar 95 – 30 Aug 96, was listed on the
OSB, but the citation was missing from the applicant’s OSR.
Applicant’s Officer Performance Report (OPR) profile for the last 5
reporting periods, from 9 Jul 95 thru 21 Oct 99, reflects all
performance factors as meeting standards.

AIR FORCE EVALUATION:
The Appeals and SSB Branch, HQ AFPC/DPPPA, reviewed this application
and recommended denial due to lack of merit. They stated the purpose
of the placement of decoration citations in the OSR is to make the
board members aware of the level of the decoration. AFI 36-2608,
Military Personnel Records System, Table A2.1, Item 326, cites that
orders granting decorations may be filed and maintained when a like
citation is not available. This speaks to the “knowledge” that a
decoration was given as opposed to the “contents” contained in the
citation. Even though the citations were not on file for the board,
they were in evidence before the board in that they were reflected on
the OSB. Therefore, the board members were knowledgeable the
decorations were given which is the ultimate purpose of including them
in the promotion selection process. Since the board members were
aware of the decorations, they were factored into the promotion
evaluation.
While it may be argued that the missing citations were factors in the
applicant’s nonselection, there is no clear evidence that it
negatively impacted his promotion opportunity. Since central boards
evaluate the entire OSR, assessing whole person factors, they were not
convinced that the missing citations contributed to the applicant’s
nonselection.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 01 September 2000, a copy of the Air Force evaluation was forwarded
to the applicant for his review and comment (Exhibit D). As of this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of probable error or injustice. We took notice of the
applicant’s complete submission in judging the merits of the case;
however, we agree with the opinion and recommendation of the Air Force
office of primary responsibility and adopt their rationale as the
basis for our conclusion that the applicant has not been the victim of
an error or injustice. Therefore, in the absence of evidence showing
that the absence of the citations for the MSM and AFCM 2OLC caused the
applicant’s records to be so misleading or inaccurate that the members
of the duly constituted selection board, applying the complete
promotion criteria, were precluded from rendering a fair determination
as to his promotion potential, we find no compelling basis to
recommend granting the relief sought in this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of probable material error or injustice;
that the application was denied without a personal appearance; and
that the application will only be reconsidered upon the submission of
newly discovered relevant evidence not considered with this
application.
