APPLICANT REQUESTS THAT:
He be considered for promotion to the grade of lieutenant colonel by
Special Selection Board (SSB) for the Calendar Year 2000 (CY00A)
Lieutenant Colonel Selection Board with the inclusion of citations
accompanying the awards of the Meritorious Service Medals, first and
second Oak Leaf Clustions.

APPLICANT CONTENDS THAT:
The promotion board was denied the opportunity to consider two full
pages of highly positive data pertaining to his duty performance which
should have been present in his record. According to the Air Force
Personnel Center counselor who provided his non-selection counseling
his record appeared to have no obvious major shortcomings and was
competitive with a sampling of records of individuals promoted by the
same board. Therefore, it is conceivable that the board would have
promoted him had they had the opportunity to consider the significant
volume of positive information improperly missing from his record.

STATEMENT OF FACTS:
The applicant is currently serving on extended active duty in the
grade of major.
Applicant was considered and not selected for promotion to the grade
of lieutenant colonel by the CY00A Lieutenant Colonel Selection Board,
which convened on 28 November 2000.
The applicant’s Officer Selection Record (OSR) contained a discrepancy
letter indicating that the citations accompanying the 1st and 2nd OLCs
to the MSM were not filed in his OSR at the time the CY00A board
convened. The Officer Selection Brief (OSB) reviewed by that board
indicated that the applicant had received the MSM 1st and 2nd OLCs.

AIR FORCE EVALUATION:
The Chief, Officer Promotions, Appointments and Selective Continuation
Branch, Directorate of Personnel Program Management, AFPC/DPPPO,
reviewed this application and states that based on the evidence
provided, they recommend denial of applicant’s request.
The applicant contends the citations for the MSM, 1OLC and 2OLC were
missing from his OSR. They agree. However, the purpose of having a
citation included in the record is not to allow board members to
review the comments on the citation, although they may do so if they
are so inclined. Rather, the purpose is to make them aware of the
level of the decoration. The personnel data system, and subsequently
the officer selection brief (OSB), did reflect award of both the MSM,
1OLC and the MSM, 2OLC. To call further attention to the fact the
applicant had been awarded the medals, there was a discrepancy letter
filed on top of the OSR to highlight to board members the citations
were missing.
Central boards evaluate the entire OSR (including the promotion
recommendation form, officer performance reports, officer
effectiveness reports, training reports, letters of evaluation,
decorations, and officer selection brief), assessing whole person
factors such as job performance, professional qualities, depth and
breadth of experience, leadership, and academic and professional
military education. Although the citations were not present in his
OSR for the board’s review, the selection board had his entire officer
selection record (including the OSB reflecting the MSM, 1OLC and 2OLC)
at their disposal during promotion consideration. In fact, every
single accomplishment mentioned in the MSM, 1OLC and MSM, 2OLC
citations is also reflected on the applicant’s OPRs and the P0500A
promotion recommendation form (PRF). Accordingly, they are not
convinced the missing decoration citations caused his promotion
nonselection.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to applicant on 27
Jul 01 for review and response. As of this date, no response has been
received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate
the existence of probable error or injustice. We note that the
contested citations for the Meritorious Service Medals, first and
second Oak Leaf Clusters, were missing from his Officer Selection
Record when it was reviewed by the CY00A Lieutenant Colonel Selection
Board. Although these awards were reflected on the Officer Selection
Brief (OSB), we believe these citations give selection board members
detailed information as to the reason for the award. While it cannot
be conclusively determined whether or not the missing citations were
the sole cause for the applicant's nonselection for promotion by the
board in question, we do believe that it served to deprive him of fair
and equitable consideration. Therefore, in an effort to remove any
possibility of an injustice to applicant we recommend the OSR be
corrected to reflect the Meritorious Service Medals, first and second
Oak Leaf Clusters, and he be provided consideration by a Special
Selection Board.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, to include the citations for the Meritorious
Service Medal, First Oak Leaf Cluster, for the period 12 December 1994
to 30 June 1997, and the Meritorious Service Medal, Second Oak Leaf
Cluster, for the period 1 July 1997 to 1 July 2000 be considered for
promotion to the grade of Lieutenant Colonel by a Special Selection
Board for the Calendar Year 2000 Lieutenant Colonel Central Selection
Board.

Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:
The pertinent military records of the Department of the Air
Force relating to APPLICANT, to include the citations for the
Meritorious Service Medal, First Oak Leaf Cluster, for the period 12
December 1994 to 30 June 1997, and the Meritorious Service Medal,
Second Oak Leaf Cluster, for the period 1 July 1997 to 1 July 2000, be
considered for promotion to the grade of Lieutenant Colonel by a
Special Selection Board for the Calendar Year 2000 Lieutenant Colonel
Central Selection Board.

The citation accompanying the MSM 1OLC was missing from the applicant’s Officer’s Selection Record (OSR) when he was considered for promotion by the CY99B board, which convened on 30 November 1999, and still is not filed in his record. In support of his appeal, the applicant provided a copy of the board discrepancy report, dated 17 Nov 99 (Exhibit A). Even though the citations were not on file for the board, they were in evidence before the board in that they were reflected on the OSB. Since the board members were aware of the decorations, they were factored into the promotion evaluation.
AFI 36-2803, The Air Force Awards and Decoration Program, 1 January 1998, states that the recommending official determines the decoration and inclusive dates; it also states that decorations will not be based on an individual’s grade, but on the level of responsibility and manner of performance.
