APPLICANT REQUESTS THAT:

His Active Duty Service Commitment  Date  (ADSCD)  of  1  Jul  01  for
Permanent Change of Station (PCS) from Wright-Patterson AFB (WPAFB) to
the University of Ohio in Athens, OH, on 2 Jul 99 be removed from  his
records.

APPLICANT CONTENDS THAT:

The correct ADSC for his PCS was not updated in his record within  the
Air Force Personnel Data System (PDS) until Jan 00  and  that  he  was
informed by personnel from the WPAFB Military Personnel  Flight  (MPF)
that he had no commitment beyond Nov 99.  He relied on this  incorrect
information to pursue and accept post-Air Force employment.

In support of his request, the applicant submits a personal  statement
with additional documents associated with  the  issues  cited  in  his
contentions.  These documents are appended at Exhibit A.

STATEMENT OF FACTS:

Information extracted from the Personnel Data System (PDS) reveals the
applicant’s Total Active Federal Military Service Date (TAFMSD) as  11
Nov 78.  He has prior enlisted service in both the Air  Force  Reserve
and the Regular Air Force (25 May 77 - 23 Apr 90).  On 23 Apr 90,  the
applicant was honorably discharged in the grade of technical  sergeant
(E-6) to accept a  commission.   On  24  Apr  90,  the  applicant  was
appointed a second lieutenant, Reserve  of  the  Air  Force,  and  was
voluntarily ordered to extended active duty.  He is currently  serving
on active duty in the grade of captain, with  an  effective  date  and
date of rank of 24 Apr 94.

On 20 Mar 00,  the  Secretary  of  the  Air  Force  Personnel  Council
disapproved the applicant’s 25 Jan 00 request for a 10-month waiver to
his PCS ADSC of 1 Jul 01, which would have changed his effective  date
of separation (DOS) to 1 Aug 00.

The relevant facts pertaining to this application are contained in the
letter  prepared  by  the  appropriate  office  of  the   Air   Force.
Accordingly, there is no need to recite these facts in this Record  of
Proceedings.

AIR FORCE EVALUATION:

The  Chief,  Officer  Separations,  HQ  AFPC/DPPRS,  stated  that   in
accordance with Air Force Instruction 36-2107, the applicant  incurred
an ADSC of 2 years from his Date Arrived on Station (DAS) of 2 Jul 99.
 In accordance with Air Force policy, the applicant  was  notified  of
his 2-year ADSC for PCS via AF Form 899, Request and Authorization for
Permanent Change of Station, dated 23 Dec 98.  Due to a combination of
administrative error  and  technical  problems  with  the  applicant’s
record within the Air Force Personnel Data System (PDS),  the  correct
ADSC date for the applicant’s PCS to Athens, OH, was  not  updated  in
his record until approximately Jan 00.

DPPRS stated that the AF Form 899, issued to the applicant in Dec  98,
clearly shows that he was notified of the correct ADSC  prior  to  his
reassignment to Athens, OH.  DPPRS indicated that after over 20  years
of active duty service and several PCS moves, it  is  highly  unlikely
the applicant honestly believed his PCS  from  WPAFB  to  Athens,  OH,
would incur no PCS ADSC--particularly after he had  been  informed  of
the ADSC via  his  PCS  orders.   DPPRS  recommended  the  applicant’s
request be  disapproved.   A  complete  copy  of  this  evaluation  is
appended at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded  to  applicant  on  7
July 2000 for review and response.  As of this date, no  response  has
been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing  law
or regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been presented  to  demonstrate
the existence of probable error or injustice.  We took notice  of  the
applicant's complete submission in judging the  merits  of  the  case.
However, we agree with the opinion and recommendation of the Air Force
office of primary responsibility and adopt the rationale expressed  as
the basis for our decision that the applicant has not been the  victim
of an error or an injustice.  In  this  respect,  we  note  that  even
though the applicant’s Permanent Change of Station (PCS) ADSC date was
not updated in the Air Force Personnel  Data  System  (AF  PDS)  in  a
timely manner, he was properly notified of the correct ADSC  prior  to
his Jul 99 reassignment to Athens, OH, via his PCS  orders,  dated  23
Dec 98.  His PCS orders clearly indicated a PCS ADSC of 24 months.  In
view of the above and absent evidence to  the  contrary,  we  find  no
compelling basis to recommend  granting  the  relief  sought  in  this
application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of probable  material  error  or  injustice;
that the application was denied without  a  personal  appearance;  and
that the application will only be reconsidered upon the submission  of
newly  discovered  relevant  evidence   not   considered   with   this
application.
