APPLICANT REQUESTS THAT:
He be provided supplemental promotion consideration to the grade of
chief master sergeant for cycle 99E9.

APPLICANT CONTENDS THAT:
A review of the contents of his SNCO Selection folder contained a
memorandum for record (MFR) dated 6 October 1999 identifying all
discrepancies with this folder logged between 1 August 1999 and 6
October 1999. The memorandum indicated that his Meritorious Service
Medal, 1st Oak Leaf Cluster (MSM, 1OLC), citation was missing from the
folder. According to the MFR an inquiry was sent to his servicing
Military Personnel Flight, however, all indications are this document
was not in his selection folder when the 99E9 cycle SNCO Selection
Board met.

STATEMENT OF FACTS:
Applicant is currently serving in the Regular Air Force in the grade
of senior master sergeant.
The applicant was considered and not selected for promotion to grade
of chief master sergeant during the 99E9 cycle. His total score was
630.45 (board score was 360.00) and the score required for selection
in his Chief Enlisted Manager (CEM) Code was 658.66. The 99E9
Evaluation Board convened on 18 October 1999.

AIR FORCE EVALUATION:
The Chief, Inquiries/AFBCMR Section, AFPC/DPPPWB, reviewed the
application and states that in accordance with AFI 36-2502, Airman
Promotion Program, Table 2.5, Rule 4, a decoration is not considered
missing if either the citation or order is filed in the Senior NCO
Selection Folder or if the decoration was listed on the Senior
Evaluation Brief reviewed by the board. Although there was no order
or citation in the record, the Senior NCO Evaluation Board was aware
the applicant had two MSMs as they were reflected on the Senior NCO
Evaluation Brief. Therefore, they recommend denial of applicant’s
request.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 18 February 2000, a copy of the Air Force evaluation was forwarded
to the applicant for review and response within 30 days. As of this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of probable error or injustice. It appears that the
citation for his MSM, 1OLC was not in his Senior NCO Selection Folder
when reviewed by the Evaluation Board. However, AFI 36-2502, Airman
Promotion Program, Table 2.5, Rule 4, states a decoration is not
considered missing if either the citation or order is filed in the
Senior NCO Selection Folder or if the decoration was listed on the
Senior Evaluation Brief reviewed by the board. The Air Force states
that although there was no order or citation in the record, the Senior
NCO Evaluation Board was aware the applicant had two MSMs as they were
reflected on the Senior NCO Evaluation Brief. In this respect, we
note that the board members had knowledge of the citation for his MSM,
1OLC. We agree with the opinion and recommendation of the Air Force
and adopt their rationale as the basis for the conclusion that the
applicant has not been the victim of an error or injustice.
Therefore, in the absence of evidence to the contrary, we find no
compelling basis to recommend granting the relief sought in this
application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of probable material error or injustice;
that the application was denied without a personal appearance; and
that the application will only be reconsidered upon the submission of
newly discovered relevant evidence not considered with this
application.

However, the decoration was not updated in the system at the time initial selects were run as evidenced by the score notice dated 17 Mar 81. Also, the MSM (1OLC) was not considered by the promotion board. We noted applicant’s contention that the MSM, 1OLC, was not considered by the promotion board; however, since this award did not close out until 30 Jun 82, and was not awarded until 22 Jul 82, it did not meet the eligibility criteria for cycle 82S9.

These decorations were reflected on the Senior NCO- Evaluation Brief and the Evaluation Board reviewed the applicant's records and assigned the 390.00 board score with full knowledge of the decorations.
