AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS

RECORD OF PROCEEDINGS

R B 1 8 7ggg

IN THE MATTER OF:

DOCKET NUMBER: 98-02722

HEARING DESIRED: NO

His Active Duty Service Commitment (ADSC) be established as
27 October 1999.

PPLICANT CONTENDS THAT:
The reasons the applicant believes the records to be in error or
unjust and the evidence submitted in support of the appeal are at
Exhibit A.

The relevant facts pertaining to this application, extracted from
the applicant's military records, are contained in the letters
prepared by the appropriate office of the Air Force.
Accordingly, there is no need to recite these facts in this
Record of Proceedings.

The Chief, Officer and Enlisted Retirements Section, AFPC/DPPRR,
reviewed this application and states that although the governing
regulation directs a five-year ADSC for the training received,
the rule is frequently misinterpreted by Military Personnel
Flight technicians. They believe the applicant accepted the
four-year ADSC in good faith and had a reasonable expectation to
believe the information presented to him.
Therefore, they
recommend his records be corrected to show that he incurred a
four-year ADSC f o r the completion of an advanced degree from
AFIT. Although the applicant contends he completed all academic
requirements on 27 October 1995, the applicant's Training Report
(TR) indicates a completion date of 20 November 1995. In view of
the above, and since the TR is the official source document to
establish the last day of training, they recommend his records be

e

corrected to show that he incurred an ADSC of 19 November 1999
for the advanced degree via AFIT.
A complete copy of the Air Force evaluation is attached at
Exhibit C.

The applicant's counsel reviewed the Air Force evaluations and
agrees with the recommendation to change his ADSC to 19 November
1999 (Exhibit E).

The applicant has exhausted all remedies provided by existing

law or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to
demonstrate the existence of probable error or injustice
warranting favorable action on the applicant's request. Counsel
contends the Air Force was extremely negligent and failed to
provide the applicant sufficient counseling regarding his ADSC.
In support of this contention, counsel submits an Officer Active
Duty Service Commitment (ADSC) Counseling Statement I AF Form 63 I
signed by the applicant and an MPF official indicating that he
would incur an ADSC of three time the length of training upon
completion of an Academic Degree Program. Although the applicant
initially requested an ADSC of 27 October 1999, the applicant's
counsel has indicated that the applicant concurs with the Air
Force's recommendation to change the ADSC to 19 November 1999.
In view of the foregoing, equity dictates that the relief sought
be granted.

The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that he received a
four-year Active Duty Service Commitment (ADSC) of 19 November
1999 as a result of his completion of Air Force Institute of
Technology Professional Education on 20 November 1995.

The following members of the Board considered this application in
Executive Session on 8 February 1999, under the provisions of AFI
36-2603 :

___________________________________________________________________ AIR FORCE EVALUATION: HQ AFPC/DPPRS recommends that the application be denied. First, prior to his entry into AFIT in 1995, the applicant states, “I was informed that I would return for a tour of no more than 3 years to Air Command and Staff College and that my actual ADSC would be determined upon completion of my degree.” They believe the applicant is referring to the standard tour length associated with his follow-on...

Calculating the AFIT commitment based on 15 months placed his last day of commitment before the ending date of the VSI program, thus qualifying him for the VSI. DPPRP indicated that if the applicant believes that non-academic days should not be factored into the ADSC computation, then they suggest that non-duty time should not be counted in calculating the discharge of the ADSC and leave and weekends should be deducted from the service credit since completion of AFIT (see Exhibit C). He...

The applicant stated he was not advised of the proper ADSC until after graduation; however, the AF Form 63 he signed on 21 August 1997, prior to his AFIT start date of 2 September 1997, clearly stated the ADSC he would incur as a result of completing an AFIT degree program. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office and adopt their rationale as the basis for our...

The applicant subsequently received a 2 May 06 RIP that updated her ADSC to 7 Jun 08 to reflect a three-year ADSC for in-residence PME. Although we recognize that the applicant could have been aware that PME normally carries a three-year ADSC, the official RIPs and PCS orders she received and acknowledged uniformly listed an ADSC for...

They indicated that the applicant requests that a SSB view his record as though he had received his master’s degree prior to the board. However, AFI 36-2501, paragraph 6.5.2, states “Consider the records of officers as they would have appeared to the original board had the officers been properly considered.” The master’s degree, which he earned in 2001, was not a matter of record for the CY00A board and therefore does not merit SSB consideration. The only time a letter is withdrawn from...

This degree is an academic and professional equivalent to the degree obtained after graduation from a School of Medicine in the United States. When a degree level and/or degree, not Air Force sponsored, are not accurately reflected in the personnel system then the member is required to contact AFIT. After reviewing the evidence of record, we are not persuaded that the applicant’s records are in error or that he has been the victim of an injustice.
