RESUME OF CASE:
Under the provisions of AFR 31-11, certain administrative corrections
had been made to two Officer Performance Reports (OPRs) and the
Promotion Recommendation Form (PRF) reviewed by Calendar Year 1992B
(CY92B) Lieutenant Colonel (LTC) board. However, the Officer
Personnel Records Review Board (OPRRB) did not incorporate all the
changes included in the proposed revised PRF submitted by the
applicant. He was given consideration by Special Selection Board (SSB)
for the CY92B board on 9 August 1993 but was not selected for
promotion.
In an AFBCMR application dated 14 December 1993, applicant requested
direct promotion to the rank of LTC with a date of rank (DOR)
retroactive to his 1977 year group. On 30 March 1995, the Board
denied his request.

After several previous requests that did not meet the criteria for
reconsideration, the applicant now presents a 20 May 1999 submission
which includes statements from individuals he believes can attest to
his accomplishments and support his claim for direct promotion and
reinstatement. Two statements from the rater of the 2 February 1990
OPR and the rater and reviewer of the 2 October 1990 OPR are also
provided.

THE BOARD CONCLUDES THAT:
After carefully reviewing the applicant’s latest submission, we remain
unpersuaded that he should be directly promoted to the grade of LTC.
The supporting statements, including those from the rater of the 2
February 1990 OPR and the rater and reviewer of the 2 October 1990
OPR, were duly noted. Although the evidence is new and relevant,
presumably it was discoverable at the time of the applicant’s initial
application and we question why he did not provide it then.
Regardless, while these individuals are undoubtedly sincere in their
belief that the applicant’s accomplishments deserved promotion, their
statements have not demonstrated that his records, as administratively
corrected through earlier appeals, did not receive full and fair
consideration by the SSB for the CY92B board. Neither they, nor the
applicant, have provided evidence sufficiently persuasive to warrant
his promotion to the grade of LTC through the correction of records
process. Therefore, we find no compelling basis upon which to
overturn the earlier Board’s decision.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of probable material error or injustice;
that the application was denied without a personal appearance; and
that the application will only be reconsidered upon the submission of
newly discovered relevant evidence not considered with this
application.
