In a letter, dated 1 6 Apr 98, the Records Procedures Branch,
AFPC/DPSRP, advised the applicant that his service records showed
that he last reenlisted in the Air Force under the name of
Albert T. Hickey. As this was the same name under which he was
retired, it was not appropriate to change his DD Form 214 or
other officialhdocuments in his records to show his present name
(Exhibit C) .
The appropriate Air Force office evaluated applicant's request
that his records be corrected to reflect award of the Armed
Forces Expeditionary Medal and provided an advisory opinion to
the Board recommending the application be denied (Exhibit D).
The advisory opinion was forwarded to the applicant for review
and response (Exhibit E). As of this date, no response has been
received by this office.
We note the applicant's request that his records be corrected to
reflect award of the Air Force Commendation Medal (AFCM) , Third
Oak Leaf Cluster (30LC), was corrected administratively.
Therefore, no further action is contemplated concerning this
request.
Evidence has not been presented which would lead us to believe
that the applicant's name was changed at thrtime or prior to his
retirement from active duty.
Accordingly, we agree with
AFPC/DPSRP's comments regarding the inappropriateness of changing
the official documents in his records to show his present name.
Accordingly, the applicant's request that his records be
corrected to reflect his name change is not favorably considered.
After careful consideration of applicant's request that his
records be corrected to reflect award of the Armed Forces
Expeditionary Medal, and the available evidence of record, we
find insufficient evidence of error or injustice to warrant
corrective action. The facts and opinions stated in the advisory
opinion appear to be based on the evidence of record and have not
been rebutted by applicant. Absent persuasive evidence applicant
was denied rights to which entitled, appropriate regulations were
not followed, or appropriate standards were not applied, we find
no basis to disturb the existing record. Accordingly, the
applicant's request is not favorably considered.

The Board staff is directed to inform applicant of this decision.
Applicant should also be informed that this decision is final and
will only be reconsidered upon the presentation of new relevant
evidence which was not reasonably available at the time the
application was filed.

SUBJECT: Application for Correction of Military Records (DD Form 149)
1. REQUESTED ACTION. Applicant requests his DD Form be changed to reflect his name
change and addition of the 3rd Oak Leaf Cluster to the Air Force Commendation Medal and
Armed Forces Expeditionary Medal.
2. BASIS FOR REQUEST. Applicant provided copy of judgment changing the applicant’s sur-
name fi-om Hickey to Wescoat and a copy of the orders and certificate awarding him the 3rd Oak
Leaf Cluster to the Air Force Commendation Medal. No explanatioddocumentation was pro-
vided regarding the b e d Forces Expeditionary Medal.
3. FACTS.
a. Applicant served on Active Duty 12 Jd 78-30 Jun 95. Since the judgment to change his
surname did not take effect until 29 Mar 96, his request to change his name on all his records is
considered irrelevant.
b. Applicant provided a copy of the orders and certificate awarding him the 3d Oak Leaf
Cluster to the Air Force Commendation Medal (his DD Form 214 only reflects 2 oak leaf clus-
ters). His records were forwarded to the appropriate office to have this addition made to his DD
Form 214, and is considered resolved administratively.
c. We can not verify the applicant’s eligibility for the Armed Forces Expeditionary Medal.

4 The Armed Forces Expeditionary Medal is awarded for various types of operations
“The area of operations is defined ... as the foreign territory on which troops have actu-
ally landed or are present and specifically deployed for the direct support of the designated mili-
tary operation.” “Direct support” is defined as services being supplied to the combat forces in
the area of operations by ground units, ships, and aircraft provided it involves actually entering
the designated area.
