MEMORANDUM FOR THE CHIEF OF STAFF
Under the authority of Section 1552, Title 10, United States
Code and Air Force Instruction 36-2603, and having assured
the
compliance with the provisions of the above regulation,
decision of the Air Force Board for Correction of Military Records
is announced, and it is directed that:

a. On 3 June 1997, he was designated a chaplain, Reserve
of the Air Force and was extended Federal recognition in the grade
of lieutenant colonel.
b. On 30 June 1997, he requested a waiver of his
Mandatory Separation Date and his request was approved by competent
authority pursuant to Title 10, United States Code, Section 14703,
thereby establishing a new Mandatory Separation Date of 7 July
2002.
c. He was not discharged from the

on 7 July 1997 and transferred to the Air Force Reserve,
8 July 1997, but was continued as an active member of the
National Guard and the Reserve of the Air Force.

d. He was credited with an additional 35 paid active duty
points, 57 paid inactive duty points and 15 membership points
during the retirement/retention year 7 June 1997 through 6 June
1998, resulting in 107 total points; and, that the period 7 June
1997 through 6 June 1998 is a satisfactory year of Federal service.

MEMORANDUM OF CONSIDERATION OF APPLICATION BEFORE THE AFBCMR
SUBJECT :
Having carefully reviewed this application, we agree with the
recommendation of the Air Force offices of primary responsibility
and adopt the rationale expressed as the basis for our decision
that the applicant has been the victim of either an error or an
injustice.' Therefore, under the authority delegated in AFI
36-2603, the applicant's records will be corrected as set forth in
the accompanying Memorandum for the Chief of Staff signed by the
Executive Director of the Board or his designee.

This memorandum responds to your March 24,1998 request for a SAFPC opinion on
subject case.
Title 10 USC, Section 14703 authorizes the Secretary of the Air Force to retain chaplains
until a specified age. Chaplain retention cases submitted to the SAFPC are n o d y approved
when the member’s chain of command supports and justifies the member’s retention as being in
the best interest of the Air Force. Subject case would have received favorable consideration by
the SAF Personnel Board if it had been submitted in a timely manner.

at ANGMPPS in sufficient time to grant approval and request Secretary of the Air
Force Approval for extension of the MSD.

This Headquarters recommends relief. We support the applicant’s request
for appointment as a professional officer (Chaplain) and we support the a
request for extension of MSD. Although supporting documentation from
ANG does not explain the delay in processing the applicant’s reappointment
application, we believe there is merit to this case. We believe the timely processing
of the MSD extension was not the fault of the applicant, and therefore an injustice
occurred. Our recommendation has been coordinated with the A.w National Guard
Chaplain’s Office.

The advisory opinions were forwarded to the applicant for review and response (Exhibit D). The applicant was considered by a medical evaluation board (MEB) on 3 Oct 93, diagnosed "Insulin Dependent Diabetes Mellitus" and therefore dmqualified for worldwide duty.
