The applicant requests that he receive a regular retirement under
the 15 year Reserve Transition Assistance Program (RTAP) program
and that he be retired in the grade of master sergeant ( E - 7 )
which was the highest grade held. Applicant's submission is at
Exhibit A.
The appropriate Air Force offices evaluated applicant's request
and provided an advisory opinions to the Board recommending the
application be denied (Exhibits C and F). The advisory opinions
were forwarded to the applicant for review and response (Exhibits
D and G). As of this date, no response has been received by this
off ice.
After careful consideration of applicant's request and the
available evidence of record, we find insufficient evidence of
error or injustice to warrant corrective action. The facts and
opinions stated in the advisory opinions appear to be based on
the evidence of record and have not been adequately rebutted by
applicant.
Absent persuasive evidence applicant was denied
rights to which entitled, appropriate regulations were not
followed, or appropriate standards were not applied, we find no
basis to disturb the existing record. Accordingly, applicant's
request is denied.
The Board staff is directed to inform applicant of this decision.
Applicant should also be informed that this decision is final and
will only be reconsidered upon the presentation of new relevant
evidence which was not reasonably available at the time the
application was filed.

The National Defense Authorization Act for Fiscal Year 1993 created the
Guard and reserve Transition Initiatives, commonly called RTAP. The purpose of
the RTAP p r o g r a was to ensure that the members of the Selective Reserve are
treated with fairness, with respect for their service to their country, and with
attention to the adverse personal consequences of Selected Reserve inactivations,
draw-downs, and involuntary separations. In Fiscal Year 1995, the RTAP program
was amended to add medically disqualified individuals with 15 but less than 20
years of satisfactory service.

_________________________________________________________________ STATEMENT OF FACTS: The applicant, a Senior Master Sergeant (SMSgt/E-8) with the OHANG, was involuntarily retired and transferred to the Retired Reserve on 2 March 2000 as a result of force downsizing. Since he was involuntarily retired, he was eligible for RTAP benefits: however, he was not entitled to any monetary benefit, only to retire early. As of this date, no response has been received by this office.
