Applicant’s Request

The application for discharge review, received 010924, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a personal appearance discharge review. The applicant listed the Veterans of Foreign Wars as the representative on the DD Form 293.


Decision

A personal appearance discharge review hearing was conducted in Washington, D.C. on 020502. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service at the time of issue. The Board’s vote was four to one that the character of the discharge shall not change. The discharge shall remain: UNDER HONORABLE CONDITIONS (GENERAL)/Unacceptable conduct (other), authority: MARCORSEPMAN, PAR. 4106.


A personal appearance discharge review was conducted in Washington, D.C. on XXXXXX. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER HONORABLE CONDITIONS (GENERAL)/Unacceptable Conduct (other), authority: MARCORSEPMAN Par. 4106.

The NDRB did note an administrative error on the original DD Form 214. Block 28, Narrative Reason for Separation should read: “_____________” vice “__________”. The original DD Form 214 should be corrected or reissued as appropriate.








THIS IS A GENERIC SHELL, EFFECTIVE 27 JUN 89 UNTIL 30 JUN 94. The finding used should be from MCO P1900.16D, effective 27 Jun 89 until 17 Aug 95. This shell is not effective after 30 Jun 94 because the Commandant of the Marine Corps issued an official list of the new DoD SPD codes and narrative reasons for separation on 940701. SPD Codes are listed on pages 1-53 through 1-58 of MCO P1900.16D, effective 27 Jun 89 until 1 Jul 94.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 930625 under honorable conditions (general) due to unacceptable conduct (other) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1. The applicant’s discharge characterization accurately reflects his service to his country. The discharge was proper and equitable.
Normally, to permit relief, an error or injustice must have existed during the period of enlistment in question. No such error or injustice occurred during the applicant’s enlistment. Additionally, there is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. However, the NDRB is authorized to consider outstanding post-service factors in the recharacterization of a discharge, to the extent that such matters provide a basis for a more thorough understanding of the applicant’s performance and conduct during the period of service under review. Verifiable proof of any post-service accomplishments must be provided in order for the applicant to claim post-service conduct and behavior as a reason to upgrade a less than Honorable discharge. The Board found the applicant did not provide sufficient documentation to mitigate the circumstances surrounding his separation and warrant an upgrade to his discharge. Relief is therefore denied.
