Applicant’s Request
The application for discharge review, received 020318, requested that the characterization of service on the discharge be changed to honorable. The Applicant requested a personal appearance hearing discharge review before the Board in the Washington National Capital Region. The Applicant listed American Legion as the representative on the DD Form 293.

Decision

A personal appearance discharge review hearing was conducted in Washington, D.C. on 021106. After a thorough review of the testimony, records, supporting documents, facts and circumstances unique to this case, NDRB discerned no impropriety but did discern an inequity in the characterization of the Applicant’s service. The Board’s vote was four to one that the character of the discharge shall change. The discharge shall change to: UNDER HONORABLE CONDITIONS (GENERAL)/Conduct triable by courts-martial (request for discharge for the good of the service), authority: MARCORSEPMAN Par. 6419.
A documentary discharge review was conducted in Washington, D.C. on XXXXXX. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Conduct triable by courts-martial (request for discharge for the good of the service), authority: MARCORSEPMAN Par. 6419.
If appropriate add the following:
The NDRB did note an administrative error on the original DD Form 214. Block 28, Narrative Reason for Separation should read: “_____________” vice “__________”. The original DD Form 214 should be corrected or reissued as appropriate.






THIS IS THE CORRECT SHELL FOR A SEPARATION IN LIEU OF TRIAL BY COURT-MARTIAL, EFFECTIVE 27 JUN 89 UNTIL 31 JUN 94, ONLY.

The finding for SILT is effective 27 Jun 89 until 17 Aug 95, however, the Commandant of the Marine Corps issued an official list of the new DoD SPD codes and narrative reasons for separation on 940701.

THE CORRECT NARRATIVE REASON FOR SEPARATION FOR SPD CODE KFS1 FROM 27 JUN 89 Until 30 JUN 94 IS “Conduct triable by courts-martial (request for discharge for the good of the service)”. (Listed on page 1-57 of MCO P1900.16D, effective 27 Jun 89) There is not a shell for SIL8707 because P1900.16C, Ch 4, effective 870729, was not applicable to par. 6419 .

A general discharge is written “ UNDER HONORABLE CONDITIONS (GENERAL)” (See MCO P1900.16D, page 1-33, effective 27 Jun 89)

An under other than honorable conditions discharge is written “UNDER OTHER THAN HONORABLE CONDITIONS” (See MCO P1900.16D, page 1-33, effective 27 Jun 89)

890811:  Charge Sheet Preferred, trial by special court-martial, for violation of Article 86, UCMJ: Unauthorized absence from 890418-890707 (79 days).
890907:  Applicant, having consulted with counsel certified under UCMJ Article 27b, requested discharge for the good of the service to escape trial by court-martial. In the request the Applicant noted that his counsel had fully explained the elements of the offenses for which he was charged and that he understood the elements of the offenses. He further certified a complete understanding of the negative consequences of his actions and that characterization of service would be under other than honorable conditions. The Applicant admitted guilt to the following violations of the UCMJ, Article 86: Unauthorized absence from 890418-890707 (79 days).
890908:  SJA review determined the case sufficient in law and fact.
890914:  GCMCA [Commanding General] determined that Applicant had no potential for further service, that separation in lieu of trial by court-martial was in the best interest of the service, and directed discharge under other than honorable conditions by reason of conduct triable by court-martial.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

 Discussion

The Applicant was discharged on 890929 under other than honorable conditions in lieu of trial by court-martial (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper but not equitable (D and E).
Issue 1. The Board found that the Applicant’s post-service conduct was sufficiently creditable to warrant an upgrade of his characterization of service to under honorable conditions (general). The Applicant’s educational achievements, service to others, personal responsibility and strong references demonstrated that the Applicant possessed character and drive that was not evident during his tour of active duty. However, the Board found that the Applicant’s post-service conduct does not sufficiently mitigate his misconduct while on active duty to warrant full relief in the form of an honorable discharge. Therefore partial relief is granted.

A. Paragraph 6419, SEPARATION IN LIEU OF TRIAL BY COURT-MARTIAL, of the Marine Corps Separation and Retirement Manual, (MCO P1900.16D), effective 27 Jun 89 until 17 Aug 95.
B. The Manual for Courts-Martial authorizes the award of a punitive discharge if adjudged as part of the sentence upon conviction by a special or general court-martial for violation of the UCMJ, Article 86, unauthorized absence for more than 30 days.
