Applicant’s Request

The application for discharge review, received 011126, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The Applicant requested a personal appearance hearing in the Washington National Capital Region. The Applicant did not list any representative on the DD Form 293.


Decision

A personal appearance discharge review hearing was conducted in Washington, D.C. on 021106. After a thorough review of the testimony, records, supporting documents, facts and circumstances unique to this case, NDRB discerned no impropriety but did discern an inequity in the characterization of the Applicant’s service. The Board’s vote was four to one that the character of the discharge shall change. The discharge shall change to: UNDER HONORABLE CONDITIONS (GENERAL)/Misconduct-Drug abuse (administrative discharge board required but waived), authority: MARCORSEPMAN Par. 6210.5.

A personal appearance discharge review was conducted in Washington, D.C. on XXXXXX. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Misconduct-Drug abuse (administrative discharge board required but waived), authority: MARCORSEPMAN Par. 6210.5.

The NDRB did note an administrative error on the original DD Form 214. Block 24, Character of Service should read “UNDER OTHER THAN HONORABLE CONDITIONS” vice “UNDER CONDITIONS OTHER THAN HONORABLE”, Block 25, Separation Authority should read: “MARCORSEPMAN Par 6210.5” vice “MCO P1900.16C Par 8410/CG's Ltr 1910 of 900424”, Block 26, Separation Code should read: “HKK1” vice “JFL1”. The original DD Form 214 should be corrected or reissued as appropriate.

The finding for Misconduct is effective 27 Jun 89 until 17 Aug 95, however, the Commandant of the Marine Corps issued an official list of the new DoD SPD codes and narrative reasons for separation on 940701.

PART I - APPLICANT’S ISSUES AND DOCUMENTATION


Issues, as submitted

1. The documents listed in section 7 of the document support issues, which were recognized by the Naval Discharge Review Board (NDRB) during my initial documents review, on September 5, 1995, as well as issues that provide a basis for upgrading my current class of discharge. Since May 1995, I have been employed with Cessna Aircraft Company. I am an Air Safety Investigator for the company. My job function is two-fold: 1) to assist the National Transportation Safety Board (NTSB) and Federal Aviation Administration (FAA) in order to provide them with aircraft technical support and data, which assists them in their determination of probable cause for aircraft accidents, 2) to bring technical data to Cessna Aircraft Company's engineering department to enhance if need be, the safety of our product. My current status working in the civilian industry as a safety professional is building my skills and knowledge to provide me with an opportunity to become a member of the National Transportation Safety Board (NTSB). I have proven to be an asset, not only to my company, but also to the continuing safety within our aviation industry. Being bilingual also allows me to coordinate and provide technical support to the government agencies in Latin America.
I have earned a Master of Science degree in Aviation Safety from Central Missouri State University (CMSU) and have completed the Mini MBA Program offered through Wichita State University (WSU). I plan on returning to school in the fall of 2002, to begin the Executive MBA Program, which will enhance my management and business skills that will be implemented in our aviation industry. I continue to give aviation safety presentations and am a mentor to college students at my "Alma Matar" CMSU.
As a contributing member of society, I am involved in The Boy Scouts of America, in Pack 714 of the Quivera Council in Wichita, Kansas. In keeping with Wichita Kansas' vision to be a model community, I volunteer my time with the "March of Dimes - Walk America Organization" and the "Kansas Special Olympics." I am also involved in the Wichita sponsored program, "Youth Entrepreneurs of Kansas" (YEK), which teach youths business skills that help them be self sufficient and productive members of society. Married now more than 10 years and with two children, (10 year old son and 5 year old daughter), my wife and I have college educations and sound employment. We have settled in the mid west making Wichita, Kansas, our home. My initial review by the NDRB was on September 5, 1995, which was based upon a review of my records and documentary evidence. The NDRB determined the discharge was appropriately issued, and relief was not warranted. I believe the enclosed documents and issues addressed comply with the issues addressed by the NDRB. The initial review by the NDRB concluded that my field, medical and dental records were not available for review. I have requested these records and have only been provided with the records enclosed. I have also requested a copy of all my records to be sent to the NDRB. It has been 11 years since my discharge from the United States Marine Corp. I feel confident that I have accomplished and will continue to accomplish post service contributions and personal achievements, which provide an adequate portrayal of a fully recovered alcoholic and drug abuser. I have made amends for my misconduct.

900405:  Commanding Officer recommended discharge under other than honorable conditions by reason of misconduct due to drug abuse. The factual basis for this recommendation was Applicant’s failure to conform to the standards of the Marine Corps. Due to Applicant’s continued misconduct and illegal use of drugs, I have determined that there is no potential for further service and, accordingly, retention is not warranted.

900416:  SJA review determined the case sufficient in law and fact.

900424:  GCMCA [Commanding General, 7
th Marine Expeditionary Brigade, FMF] directed the Applicant's discharge under other than honorable conditions by reason of misconduct due to drug abuse.

960220:  NDRB documentary record review Docket Number MD95-01613 conducted. Determination: discharge proper and equitable; relief not warranted.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 900511 under other than honorable conditions for misconduct due to drug abuse (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper but not equitable (C and D).

Issue 1. The Board found that the Applicant’s post-service conduct was sufficiently creditable to mitigate his misconduct while on active duty and warrant an upgrade of his characterization of service to under honorable conditions (general). The Applicant’s education, volunteer service, career progression, and strong references demonstrated that the Applicant possessed character and drive that was not evident during his tour of active duty. Relief granted.
