Applicant’s Request

The application for discharge review, received 010712, requested that the reason for the discharge be changed to something other than alcohol abuse. The applicant requested a documentary record discharge review. The applicant did not designate a representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 020130. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the reason for discharge shall not change. The discharge shall remain: HONORABLE/Alcohol Abuse - rehabilitation failure, authority: MILPERSMAN, Article 3630550.


PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues

1. I was not an alcohol rehabilitation failure. I never went through a recovery program, nor was I ever referred to a substance abuse doctor or professional. I was never disciplined for an alcohol-related offense. Having alcohol as a reason for discharge on my DD-214 has had a very detrimental effect on my life. Plus, it is simply not true.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 920115 with an honorable discharge due to alcohol abuse - rehabilitation failure (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The applicant’s issue states: “I was not an alcohol rehabilitation failure. I never went through a recovery program, nor was I ever referred to a substance abuse doctor or professional. I was never disciplined for an alcohol-related offense. Having alcohol as a reason for discharge on my DD-214 has had a very detrimental effect on my life. Plus, it is simply not true.” The Board found that the applicant’s service and medical records were incomplete. The applicant requested the reason for discharge be changed from Alcohol abuse- rehabilitation failure to “something other than alcohol abuse.” The Board presumed regularity in the conduct of government affairs. The applicant did not provide documentation to sufficiently rebut the presumption of regularity. The Board found that the reason for discharge was properly and equitably assigned. Relief is not warranted.

The applicant remains eligible for a personal appearance hearing provided the application is received within 15 years from the date of discharge. Representation at personal appearance hearing is highly recommended.
