Applicant’s Request

The application for discharge review, received 000211, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The applicant requested a documentary record discharge review. The applicant did not designate a representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 000907. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/ Misconduct – Drug abuse (Use), authority: NAVMILPERSMAN, Article 3630620.

The NDRB did note an administrative error on the original DD Form 214. Block 4a, Grade, Rate or Rank, should read: "MMFR" vice "MMFA", and Block 4b, Pay Grade, should read: "E1" vice "E2". The original DD Form 214 should be corrected or reissued as appropriate.

890516:  Commanding officer recommended discharge under other than honorable conditions by reason of misconduct due to drug abuse (use) and misconduct due to pattern of misconduct. Commanding officer’s comments (verbatim): "MMFR (Applicant) blatantly violated the rules and regulations of the naval service by knowingly using cocaine on two occasions. MMFR (Applicant)'s defense counsel states in his appeal letter that the senior member was not a line officer; that with the other ships alongside in Bahrain as well as the USS LASALLE, an 0-4 line officer could have been obtained. I would point out that both my 0-4 line officers had been used previously in court-martials which made them ineligible to sit as senior member. One 0-4 was the summary court-martial in the case of Respondent, the other 0-4 was working in Engineering for her EOOW qualifications. All the ships alongside were there for just a few days and the time involved sending the proceedings through the mail would have seriously jeopardized the processing of this case. Since an 0-4 line officer was not available and the Respondent was a minority, the 0-4 staff corps officer was a minority. Further, the defense counsel did not object to the senior member sitting at the time of the admin board. This is only a last minute effort to have the proceedings ruled as invalid.
         Defense counsel objects to the summary court-martial conviction of the Respondent for the use of cocaine being considered when it was still under appeal to COMIDEASTFOR. I would point out that it was the accused that stated while under oath in front of the Admin Board that he admitted to the use of cocaine. I see nothing extraordinary in this case to cause me to change my view. I concur with the findings of the Admin Board and recommend that the defense counsel appeal be denied."

PART III – RATIONALE FOR DECISION AND PERTINENT
REGULATION/LAW

Discussion

The applicant was discharged on 890802 under other than honorable conditions for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

In response to the applicant’s issue, the Board found that the applicant’s discharge was not based solely on “one isolated incident”. In addition to violating UCMJ Article 112a, wrongful use of a controlled substance(2 specs, cocaine), the applicant also violated UCMJ Article 86, unauthorized absence(9 specs, total 47 days); UCMJ Article 92, disobeying a lawful order(2 specs) and UCMJ Article 87, missing ships movement.
The applicant is responsible for his actions and must accept the consequences of his misdeeds. Relief denied.
