Applicant’s Request

The application for discharge review, received 020611, requested that the characterization of service on the discharge be changed to honorable. The Applicant requested a documentary record discharge review. The Applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 030311. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the NDRB discerned there was no impropriety or inequity in the characterization of the Applicant’s service or the assigned reason for discharge, at the time of discharge. However, after consideration of the Applicant’s post-service documentation the Board determined that partial relief is warranted. The Board voted four to one that the discharge characterization shall change. The Board found the reason for discharge shall remain the same. The discharge shall change to: UNDER HONORABLE CONDITIONS (GENERAL)/Misconduct - Pattern of Misconduct, authority: NAVMILPERSMAN, Article 3630600.



PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues, as submitted

1. My purpose for enlisting into the U.S. Navy was to serve our country and to establish a better life for myself. Instead I found myself caught in a vicious cycle of liberty port parties that eventually took it’s toll on my intended career. While serving on the USS Elliot my personal evaluations reached an high average, starting in the Deck Division and within 5 months struck out to M.S. and excelled to become the ward room cook, stretcher bearer and flight quarters crash & smash. I was zealous and eager with every intention to fulfill my obligations, however, because of my lack of self control leading me to stand before the board. They couldn't see how I could have been a total different person in contrast to my potential and ability to perform what was required. I was given punishment instead of possible treatment or counseling due to the periods of absences "91 Aug 31 to Sep 01", "92 Feb to Mar 03 and "92 May 17 to 92 Jun 14". During the period of 92 May 17 to 92 June 14 I was incorrectly told that I could leave and the papers would be sent to my address in the city of my M.E.P. station. I didn't know any different. I was scared and felt defeated with nowhere to turn so I flew back home (Boston). Thereafter, I received a letter requesting my return back to California. I then and still do regret making bad decisions during my active duty. However, my life I live today would demonstrate the complete opposite of then (demonstrated through Document 1-4 that I am submitted). Thank you.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 920715 under other than honorable conditions for misconduct due to a pattern of misconduct (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D) at time of issue. However, after consideration of the Applicant’s post-service accomplishments and good citizenship the Board determined that partial relief was warranted. The Board voted four to one that the discharge characterization shall change to Under Honorable Conditions (General). The reason for discharge shall remain the same. The Board determined that the seriousness of the Applicant’s misconduct prevented changing the discharge characterization to fully Honorable.

Issue 1: The Applicant requested an upgrade to his discharge characterization based upon his post-service conduct. While there is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service, the NDRB is authorized to consider outstanding post-service factors in the recharacterization of a discharge, to the extent that such matters provide a basis for a more thorough understanding of the Applicant’s performance and conduct during the period of service under review.
The Applicant has demonstrated a substantial and verifiable change in lifestyle and has shown a fervent commitment to dedicating his life to his family, taking a leadership role in his community, and living a faith-based lifestyle. The Board noted the significant changes and positive direction the Applicant’s life has taken since he made a commitment to drug-free, sober living. After careful consideration of the Applicant’s post-service accomplishments and documentation, the Board found that partial relief is warranted.
