Applicant’s Request

The application for discharge review, received 991221, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The applicant requested a personal appearance before the board in the Washington National Capital Region. The applicant listed the American Legion as his representative on the DD Form 293.


Decision

A personal appearance hearing discharge review was conducted in Washington, D.C. on 000711. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety, but did find inequity in the characterization of the applicant’s service, at the time of discharge. However, the Board determined that relief is warranted in this case based on the a review of the member’s complete record, specifically including evidence of outstanding post-service conduct. The Board’s vote was three to two that the character of the discharge shall change. The discharge shall change to: GENERAL (UNDER HONORABLE CONDITIONS)/Misconduct – Drug abuse (Use), authority: NAVMILPERSMAN, Article 3630620.

850530:  NJP for violation of UCMJ, Article 112A (4 specs): (1) Wrongful use of marijuana, (2) Wrongful possession of marijuana, (3) Wrongful use of Quaaludes, (4) Wrongful possession of Quaaludes.
         Award: Forfeiture of $469.35 per month for 2 months, restriction for 60 days, reduction to STG3. No indication of appeal in the record.

850531:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to drug abuse as evidenced by receiving Commanding Officer's nonjudicial punishment on 30 May 1985 for use and possession of marijuana, and use and possession of "Lemmon 714" Quaalude.

850531:          Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights.

850604:  Medical evaluation for drug abuse found the applicant as non-drug/alcohol dependent.

850607:  Substance Abuse Report: Abuse and possession of marijuana and Quaaludes, April 1985, ashore off duty, law enforcement. Medical officer found applicant not dependent and recommended separate from service. Commanding officer recommended separate. Comments: 25 yr ___ found with possession of THC and Quaaludes in POV after auto accident. Probable cause sample tested positive for both drugs. Received Captains NJP and is being processed for administrative discharge. No prior disciplinary record. Medical officer evaluation indicated non-drug dependency. Disqualified from PRP program. PART III – RATIONALE FOR DECISION AND PERTINENT
REGULATION/LAW

Discussion

The applicant was discharged on 850717 under other than honorable conditions for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the character of discharge was proper at the time of member's discharge, but determined to be inequitable in light of this review.

The applicant’s representative submitted the following as issue 1: (EQUITY ISSUE) As the documentary evidence of record supports, this former member opines that his post-service conduct has been sufficiently creditable to warrant the Board’s relief as authorized under provisions of SECNAVINST 5420.174C, enclosure (1), paragraph 9.3. The Board determined that relief is warranted in this case based on a review of the member’s complete record, specifically including evidence of outstanding post-service conduct. However, the Board determined that while the applicant’s post-service conduct warrants an upgrade to General (Under Honorable Conditions), the absence of more community service documentation and the severity of the applicant’s misconduct does not warrant an Honorable discharge.
