Applicant’s Request

The application for discharge review, received 991129, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 000831. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/UNSAT PARTICIPATION IN READY RESERVE, authority: MARCORSEPMAN 6213.

1. I was a L. Corporal on the split reserve program. I broke my toe on my part-time job as a bouncer and was put on TMPQ, as a result I needed to find a job and no one would hire me knowing I would have to leave for 3 mos. Also, I brought in a doctors note saying (that I turned in) I was O.K. to go to S.O.I. on time and they choose to delay my training, so I needed to take a job, thus my time with the Marines ended. At the time I requested an other than honorable, just to end it more quickly.

Chronological Listing of Significant Service Events :

940515:  Enlistment contract into the USMCR documents acknowledgement of the requirement to participate in 48 scheduled drills and not less than 14 days of annual training per year for 6 years upon completion of initial active duty training.

951015:  Counseled for deficiencies in performance and conduct. [Unsatisfactory participation in reserve training due to unexcused absence from scheduled drill periods.] Necessary corrective actions explained, sources of assistance provided, disciplinary and discharge warning issued.

951015:  Commanding officer notified the applicant of unsatisfactory drill participation via certified letter.

951106:  Commanding officer notified the applicant of unsatisfactory drill participation via certified letter.

951207:  Letter of intent to administratively separate under other than honorable conditions for the failure to participate in reserve training was sent via certified mail, return receipt requested. Applicant receipted for letter by return signature but failed to acknowledge the contents. [The failure to acknowledge official certified mail constitutes acknowledgement and waiver of all rights (MARCORSEPMAN par. 6303)]

960122:  Commanding officer notified the applicant of unsatisfactory drill participation via certified letter.

960126:          Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.

960207:  Commanding officer recommended discharge under other than honorable conditions by reason of misconduct due to unsatisfactory participation in the Ready Reserve. The factual basis for this recommendation was between 13 October 1995 and 5 November 1995 you absented yourself without proper authority from 9 drill periods. To date, you have made no effort to resolve any of these 9 drills; despite efforts by members of this command to assist you in resolving all absences.

960429:  SJA review determined the case sufficient in law and fact.

960429:  GCMCA [Commander, Marine Forces Reserve] directed the applicant's discharge under conditions other than honorable by reason of misconduct due to unsatisfactory participation in the Ready Reserve.


PART III – RATIONALE FOR DECISION AND PERTINENT
REGULATION/LAW

Discussion

The applicant was discharged on 960516 under other than honorable conditions for misconduct due to unsatisfactory participation in the Ready Reserve (A, B, and C). The Board presumed regularity in the conduct of governmental affairs (D). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (E and F).

In response to the applicant’s issue, the Board, t o permit relief, must find an error or injustice to have existed during the period of enlistment under review. There was nothing in the records, nor did the applicant provide any documentation, to indicate there existed an error of fact, law, procedure, or discretion at the time of discharge. There was no rights violation and no basis for relief. The NDRB recognizes that serving in the Marine Corps is very challenging. Our country is fortunate to have men and women willing to endure the hardships and sacrifices required in order to serve their country. It must be noted that most Marines serve honorably and well and therefore earn honorable discharges. In fairness to those Marines, commanders and separation authorities are tasked to ensure that undeserving Marines receive no higher characterization than is due. While the NDRB respects the fact that the applicant “needed to find a job”, his service is equitably characterized as being performed under other than honorable conditions. Relief is not warranted.
