Applicant’s Request

The application for discharge review, received 000913, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The applicant requested a personal appearance hearing before a Traveling Panel closest to (left blank). The applicant did not designate a representative on the DD Form 293. In the acknowledgement letter to the applicant, he was informed that the Naval Discharge Review Board (NDRB) first conducts a documentary review prior to any personal appearance hearing.


Decision

A documentary discharge review was conducted in Washington, D.C. on 010309. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/UNSAT PARTICIPATION IN READY RESERVE, authority: MARCORSEPMAN 6213.


PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues

1. I now have a child that I need to take care of and my discharge is stoping me from being able to get a good job. All the jobs require you to have a honorable, under honorable, or general discharge to work if you have been in the military.

2. While in the Marines and when I had first joined I had to many things going on and I could not focuss like I should have focussed. I was juggling school, civilian work, college band, and the Marines all at one time and I failed and I honestly regret my mistakes.

3. While in the Marine Corps Reserves I did not have the proper transportation to commute back and forward to drills and scheduled events.

980507:  Commanding officer recommended discharge under other than honorable conditions by reason of misconduct due to unsatisfactory participation in the Ready Reserve. The factual basis for this recommendation was due to excessive unexcused absences from 7 September 1996, through this date.

980514:  Counseled for deficiencies in performance and conduct [declared an unsatisfactory participant due to unresolved unexcused absences]. Necessary corrective actions explained, sources of assistance provided, disciplinary and discharge warning issued. (SNM NOT AVAILABLE FOR SIGNATURE.)

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 980705 under other than honorable conditions for misconduct due to unsatisfactory participation in the Ready Reserve (A, B, and C). The Board presumed regularity in the conduct of governmental affairs (D). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (E and F).

The applicant introduced no decisional issues for consideration by the Board.

The applicant executed understanding of his reserve obligation, by signing in his own hand on 960202 and 960205 his total eight year obligation. The applicant further failed to acknowledge all certified mail attempts to contact him, in willful disregard of the rules and regulations he contracted to obey.
The applicant was advised that if discharged under other than honorable conditions, it might deprive him of virtually all veterans' benefits based upon his current enlistment, and that he might expect to encounter substantial prejudice in civilian life in situations wherein the type of service rendered or the character of discharge received therefrom may have a bearing. The Board finds nothing in the record to mitigate the other than honorable discharge awarded as a result of the applicant’s misconduct in failing to attend required reserve drills. Relief denied.

The applicant is reminded that he is eligible for a personal appearance hearing provided the application is received within 15 years from the date of discharge. Representation at a personal appearance hearing is highly recommended.
