Applicant’s Request
The application for discharge review, received 020403, requested that the characterization of service on the discharge be changed to honorable. The Applicant requested a documentary record discharge review. The Applicant did not list any representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 030116. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the Applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/UNSAT PARTICIPATION IN READY RESERVE, authority: MARCORSEPMAN 6213.

PART I - APPLICANT’S ISSUES AND DOCUMENTATION


Issues, as submitted

 1. The reason I was UA from AT, is because I lost my job and could not afford to go. Gunnery Sergeant M_ told me that he would take care of everything, and that I could make up AT when they got back. When the unit got back from AT, Gunnery Sergeant M_ called me and asked why I didn't go to AT, like we never spoke about me losing my job, and not being able to go. Another incident was when they told me I needed to make up my missed drills, I had no problem with that because I wanted to get back to good drill status and work everything out. I was informed that I was to get with the I&I staff to schedule my drill times at their convenience. When I spoke to the I&I staff, they told me I needed to make up my missed drills during the week, and without pay. I also felt like my new job was in jeopardy if I couldn't work during the week. I regret not being able to get everything taken care of while I was in, but I feel like they could have worked with me a little more. The reason I am submitting this document, is because I would like my discharge changed to Honorable for if I decide to re-enlist in the active Marine Corps, I will be eligible to do so.

981104:  Applicant released from initial tour of active duty for training with an Honorable by reason of completion of required active service (USMCR) IADT.

 000822:  Commanding Officer notified the Applicant of unsatisfactory drill participation via certified letter.
000822:  Letter of intent to administratively separate under other than honorable conditions for the failure to participate in reserve training was sent via certified mail, return receipt requested. Applicant receipted for letter by return signature but failed to acknowledge the contents. The failure to acknowledge official certified mail constitutes acknowledgement and waiver of all rights (MARCORSEPMAN par. 6303).
000910:  Reduced to PFC due to unsatisfactory participation.
001013:  Reduced to Private due to unsatisfactory participation.

 001129:  Affidavit of Service for record of notification of administrative separation proceedings.       

001204:  Commanding Officer recommended discharge under other than honorable conditions by reason of misconduct due to unsatisfactory participation in the Ready Reserve. The factual basis for this recommendation was accumulation of 19 unexcused absences from scheduled drills and missing Annual Training.
010416:  GCMCA [Commander, Marine Forces Reserve] directed the Applicant's discharge under conditions other than honorable by reason of misconduct due to unsatisfactory participation in the Ready Reserve.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 010425 under other than honorable conditions for misconduct due to unsatisfactory participation in the Ready Reserve (A, B, and C). The Board presumed regularity in the conduct of governmental affairs (D). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (E and F).
Issue 1. The Board found that the Applicant’s concerns about his civilian job do not mitigate his misconduct. The Board found no inequity or impropriety in the Applicant’s statement that he was expected to make up lost drills on weekdays and without pay. While he may feel that the USMC should have adjusted to his individual circumstances, the record clearly reflects his disregard for the requirements of military discipline and demonstrated that he was unfit for further service. The Applicant was noted by his chain of command for his lack of dependability. The record is devoid of evidence that the Applicant was not responsible for his conduct or that he should not be held accountable for his actions. Relief denied.
The Applicant’s discharge characterization accurately reflects his service to his country. The discharge was proper and equitable. Normally, to permit relief, an error or inequity must have existed during the period of enlistment in question. No such error or inequity is evident during the Applicant’s enlistment. Additionally, there is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. Relief not warranted.

The Applicant is reminded that he remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of his discharge. Representation at a personal appearance hearing is recommended but not required.
