This is in reference to your application for correction of your naval record pursuant to the provisions of title 10 of the United States Code section 1552.

After careful and conscientious consideration of the entire record, the Board found that the evidence submitted was insufficient to establish the existence of probable material error or injustice.

You enlisted in the Navy on 1 July 1986 at age 22. On 11 August 1986 you were counseled and warned following the commission of several minor disciplinary infractions. On 18 August 1986 you were diagnosed with an adjustment disorder with depressed mood which had resolved. On 20 August 1986, a recruit aptitude board recommended an entry level separation. The next day, you were notified of separation processing because of unsatisfactory performance and/or failure to adapt to the military environment. Although you objected to separation, the commanding officer of the Recruit Training Command directed an entry level separation because of your failure to adapt to the military environment. You were separated on 9 September 1986 with two months and nine days of active service.


In your application you are requesting that the character of your service be changed to honorable instead of the entry level separation currently entered in the characterization of service block on your DD Form 214. You are making this request because the Department of Veterans Affairs considers your service to be honorable for its purposes. The law and appropriate regulations allow for the issuance of an uncharacterized entry level separation to individuals separated within the first six months of service. Since you have been treated no differently than
others in your situation, the Board could not find an error or injustice in your case.

Accordingly, your application has been denied. The names and votes of the members of the panel will be furnished upon request.

It is regretted that the circumstances of your case are such that favorable action cannot be taken. You are entitled to have the Board reconsider its decision upon submission of new and material evidence or other matter not previously considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice.
