This is in reference to your application for correction of your naval record pursuant to the provisions f 10 USC 1552.

A three-member panel of the Board or Correction of Naval Records, sitting in executive session, con si dered your application on 20 March 2007. Your allegations o error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of t is Board. Documentary material considered by the Board consisted f your application, together with all material submitted in support hereof, your naval record and applicable statutes, regulations a d policies. In addition, the Board considered the advisory opinion furnished by NPC Memo 1160 Ser 4811/093 dtd 26 Feb 07, a copy of w hich is attached.

After careful and conscientious consideration of the entire record, the Board found that the evidence submitted was insufficient to establish the existence of probable material error or injustice. In this connection, the Board substantially concurred with the comments contained in the advisory opinion. Accordingly, your application has been denied. The names and votes f the members of the panel will be furnished upon request.

It is regretted that the circumstances of your case are such that favorable action cannot be taken. Y ou are entitled to have the Board reconsider its decision upon submission of new and material evidence or other matter not previously considered by the Board. In this regard, it is important to keep in m in d that a presumption of regularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice.

MEMORANDUM FOR CHAIRMAN, BOARD FOR CORRECTION OF NAVAL RECORD

1.       In response to reference (a), recommend disapproval to the petitioner’s request.

2.       The petitioner enlisted in the Navy for four years on 09 January 2003. The petitioner signed a 12 months NAVPERS 1070/621 extension on 13 February 2003 to establish eligibility for the Enlistment Bonus
(EB). The petitioner signed a NAVPERS 1070/613 agreeing to accept assignment to the MA/SG program and EB. This established an EAOS of 08 January 2007 with an extended EAOS of 08 January 2008. The member
requests to adjust cancel the extension agreement.

3.       Reference (b) authorizes cancellation of extension provided member does not receive benefits for which the extension was executed. The member received the EB and received training in the MA rating.

4.       In view of the above recommend no change to the petitioner’s record.

5.       This is an advisory memorandum to reference (a) for the use by the Board for correction of Naval Records (BCNR) only. Enclosure (1) is returned.
