This is in reference to your application for correction of your naval record pursuant to the provisions of 10 USC 1552.

A three-member panel of the Board for Correction of Naval Records, sitting in executive session, considered your application on 11 October 2006. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, your naval record and applicable statutes, regulations and policies. In addition, the Board considered the advisory opinion furnished by NPC MEMO 1160 SER 4811/505 dtd 16 August 2006, a copy of which is attached.

After careful and conscientious consideration of the entire record, the Board found that the evidence submitted was insufficient to establish the existence of probable material error or injustice. In this connection, the Board substantially concurred with the comments contained in the advisory opinion. Accordingly, your application has been denied. The names and votes of the members of the panel will be furnished upon request.

It is regretted that the circumstances of your case are such that favorable action cannot be taken. You are entitled to have the Board reconsider its decision upon submission of new and material evidence or other matter not previously considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice.

1.       In response to reference (a) , recommend no change to the petitioner’s record.

2.       The petitioner signed a five—year reenlistment contract on 08 (October 2002. The petitioner received a zone “A” SRB with an award level of 4.5 for the FC(l334) rate/NEC. The petitioner’s EAOS at the time of reenlistment was 08 February 2003. The petitioner states that the SRB bonus payment was based on a four-year reenlistment term.

3.       The current MMPA data record indicates the petitioner received a total payment amount of $36,005.06 with an initial installment of $18,002.53. The petitioner’s SRB was based on 1,650 total days converted to 55 months zone “A” computation.

4.       The petitioner’s SRB payment was based on 60-month reenlistment term minus obligated service between reenlistment and EAOS.

5.       In view of the above recommend the petitioner’s SRB payment remain as is.

6.       This is an advisory memorandum to reference (a) for the use by the Board for correction of Naval Records (BCNR) only. Enclosure (1) is returned.
