This is in reference to your application for correction of your naval record pursuant to the provisions of title 10 of the United States Code, section 1552.

A three—member panel of the Board for Correction of Naval Records, sitting in executive session, considered your application on 22 March 2005. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, your naval record and applicable statutes, regulations and policies. In addition, the Board considered the advisory opinion furnished by CNO memorandum 5420 SerN13OD1/05U0171 dated, 10 March 2005 a copy of which is attached.

After careful and conscientious consideration of the entire record, the Board found that the evidence submitted was insufficient to establish the existence of probable material error or injustice. In this connection, the Board substantially concurred with the comments contained in the advisory opinion. Accordingly, your application has been denied. The names and votes of the members of the panel will be furnished upon request.

It is regretted that the circumstances of your case are such that favorable action cannot be taken. You are entitled to have the Board reconsider its decision upon submission of new and material evidence or other matter not previously considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice.

1.       N130 recommends disapproval of I~IUIIUU1MWUm~ petition to change her Enlistment Bonus (EB) to “the amount I signed for prior tobootcamp”.

2.       ~ request was reviewed and all information provided in the CNO Comment and Recommendation letter (N13001/04U0573 dated 12 Aug 04) was determined to be accurate and correct.

3.       ~IU~I~~UiP qualifies for an $8,000 EB. No further action is required.

1.       The following provides comment and recommendation on petition.

2.       N130 recommends disapproval of ~ petition for an Enlistment Bonus (EB) in the amount of $12,000.

3.       NI~UflI~hi entered the Delayed Entry Program (DEP) on 15 January 2002, volunteered for the Nuclear Field Program Guarantee, College Assistance/Student Headstart (CASH) Program, and signed an EB contract in the amount of $12,000. She entered active duty via the CASH program 18 December 2002 and shipped to Recruit Training Center (RTC) 27 June 2003. In her petition
~        favorable action that would allow payment of an EB of $12,000.

4.       In accordance with reference (a) EB entitlement for members enrolled in the CASH program will be based on the date the member reports to RTC and the EB message in effect at the time of DEP enlistment. NAVADMIN 180/01 201100Z Jul 01 (message in effect at the time dJUUU~q~~qI~Iq5Ientered the DEP), a member entering the Nuclear Field program and shipping to RTC June through September, is eligible for an EB at the award level of $8,000. ~IUUUPIE~Uuiii~i qualifies for an EB of $8,000. Recommend BCNR update the members Annex “C” to her DD Form 4 to reflect an EB in the amount of $8,000. As of this date member can be paid 20% of her EB.
