I .   Pursuant  to  tlie provisions of  reference (a), Subject  hereinafter referred  to  as  Petitioner, 
filed  enclosure  ( 1 )   with  this  Board  requesting,  i n  effect,  that  the applicable naval  record  be 
corrected  to  show  that  he  elected  to  participate in  the  MGIB  Progranl  when  first  eligible. 

2. The Board,  consisting of  Messrs.  Bishop,  Milner,  and  Cooper,  reviewed  Petitioner's 
allegations of  error and  i~ijustice on  30 April  02 and,  pursuant  to  its  regulations, determined 
that  tlie  corrective  action  indicated below  should  be  taken  on  tlie  available evidence of 
record.  Documentary  material  considered  by  the  Board  consisted of  tlie  enclosures,  naval 
records,  and  applicable statutes,  regulations and  policies. 

3.  The  Board,  having  reviewed  all  the  facts of  record  pertaining  to  Petitioner's allegations 
of  error  and  iri.justice,  finds as  follows: 

a.  Before  applying to  this  Board,  Petitioner exhausted all  administrative remedies 

available under  existing law  and  regulations within  the  Del~art~nent of  tlie  Navy. 

Upon  review  and  consideration of  all  tlie evidence of record,  and  especially i n   light of  the 
contents of  enclosure  (2), tlie  Board  finds tlie existence of  an  injustice warranting  the 
following corrective action.

RECOMMENDATION: 

That  Petitioner's naval  record  be  corrected,  where appropriate, to  show  that  on  30  March 
1987, during  the  VEAP open  enrollliient  period,  he  elected  to  participate in  the  VEAP and 
further corrected  to  show  that  on  10 Octo\xr 1996, during  the  VEAP  to  MGIB  conversion 
period,  he  executed a  MGlB Election  Form  (DD Form  2366) and  that  this election  fortn 
retlects  that  he  elected  to  participate in  the  MGIB Prograni. 

a.  That  a copy  of  this  Report  of  I-'roceedings be  filed  in  Petitioner's naval  record. 

4.  Pursuant  to  Section 6(c) of  the  revised  Procedures of  the  Board  for  Correction of Naval 
Records (32 Code of  Federal  Regulations, Section 723.6(c)) it  is certitied  that  quorum was 
present  at  the  Board's  review atld  deliberations,  and  that  tlie  foregoing is  a  true and  complete 
record  of  the  Board's proceedings i n   the  above entitled  niatter.
