RECORD OF PROCEEDINGS
IN THE CASE OF:
BOARD DATE: 21 March 2006
DOCKET NUMBER: AR20050011727
I certify that hereinafter is recorded the true and complete record
of the proceedings of the Army Board for Correction of Military Records in
the case of the above-named individual.
| |Mr. Carl W. S. Chun | |Director |
| |Mr. Joseph A. Adriance | |Analyst |
The following members, a quorum, were present:
| |Mr. John N. Slone | |Chairperson |
| |Ms. Yolanda Maldonado | |Member |
| |Mr. Robert D. Morig | |Member |
The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion,
if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, that the date of birth (DOB) entered
in
Item 9 (Date of Birth) and the military occupational specialty (MOS)
entered in Item 23a (Specialty Number and Title) of his 16 April 1969
separation document (DD Form 214) be corrected.
2. The applicant states, in effect, that wrong DOB and MOS are listed on
his DD Form 214. He claims he did not notice the mistakes because he could
not read or write. He further indicates that he explained to the
separations clerk that he had been helping the cooks, which resulted in his
MOS being changed from 11B (Infantry).
3. The applicant provides the following documents in support of his
application: Birth Certificate; Combat Training Certificate; DD Form 214;
and Demilitarized Zone (DMZ) Certificate.
CONSIDERATION OF EVIDENCE:
1. The applicant is requesting correction of an alleged error or injustice
that occurred on 16 April 1969. The application submitted in this case is
dated
3 August 2005.
2. Title 10, U.S. Code, Section 1552(b), provides that applications for
correction of military records must be filed within 3 years after discovery
of the alleged error or injustice. This provision of law allows the Army
Board for Correction of Military Records (ABCMR) to excuse failure to file
within the 3-year statute of limitations if the ABCMR determines that it
would be in the interest of justice to do so. In this case, the ABCMR will
conduct a review of the merits of the case to determine if it would be in
the interest of justice to excuse the applicant’s failure to timely file.
3. A Record of Induction (DD Dorm 47) on file confirms the applicant was
inducted into the Army and entered active duty on 12 September 1967. Item
5 (Date of Birth) of this document contains the date 30 May 1946.
4. The applicant's Enlisted Qualification Record (DA Form 20), which was
prepared on him upon his entry on active duty, contains the entry 30 May
1946 in Item 6 (Date of Birth). Item 22 (Military Occupational
Specialties) shows that the applicant was awarded MOS 11B (Infantryman) on
31 January 1968, and MOS 94B (Cook) on 15 August 1968, at which time MOS
11B was withdrawn. Item 38 (Record of Assignments) shows that he served in
MOS 94B from 31 January 1969 through the date of his separation.
5. On 16 April 1969, the applicant was honorably separated after
completing 1 year, 7 months, and 3 days of active military service. The DD
Form 214 he was issued contains the entry 20 May 1946 in Item 9 (Date of
Birth) and the entry 94B20 Cook in Item 23a (Specialty Number and Title).
The applicant authenticated this document with his signature in Item 32
(Signature of Person Being Transferred or Discharged).
6. The applicant provides a DMZ Certificate of Achievement that he
received for his service while assigned to the Korean DMZ from January 1969
through 10 April 1969, and a Certificate of Training he was issued upon his
successful completion of Basic Combat Training. He also provides a Birth
Certificate that confirms his DOB was 30 May 1946.
DISCUSSION AND CONCLUSIONS:
1. The applicant's contention that the DOB entered in Item 9 of his DD
Form 214 is in error was carefully considered and found to have merit. The
evidence of record confirms that the applicant's DOB was in fact 30 May
1946, as evidenced by entries on his DD Form 47, DA Form 20, and birth
certificate. As a result, it would be appropriate to correct his DD Form
214 to reflect his correct DOB.
2. The applicant's contention that the MOS entered in Item 23a of his DD
Form 214, which shows he was a cook, was in error was also carefully
considered. However, there is insufficient evidence to support this claim.
The evidence of record, while showing that the applicant completed
infantry training and was initially awarded MOS 11B, confirms his infantry
MOS was withdrawn and he was awarded the cook MOS of 94B in August 1968.
Further, his DA Form 20 confirms he served as a cook from 31 January 1969
through the date of his separation. Thus, the MOS entry in Item 23a of his
DD Form 214 is an accurate reflection of his record, and it would not be
appropriate to change it at this late date.
BOARD VOTE:
________ ________ ________ GRANT FULL RELIEF
___JNS__ __YM __ __RDM__ GRANT PARTIAL RELIEF
________ ________ ________ GRANT FORMAL HEARING
________ ________ ________ DENY APPLICATION
BOARD DETERMINATION/RECOMMENDATION:
1. The Board determined that the evidence presented was sufficient to
warrant a recommendation for partial relief and to excuse failure to timely
file. As a result, the Board recommends that all Department of the Army
records of the individual concerned be corrected by amending Item 9 (Date
of Birth) of his 16 April 1969 DD Form 214 by deleting the current entry
and replacing it with the entry
"30 May 1946"; and by issuing him a correction to his separation document
that reflects this change.
2. The Board further determined that the evidence presented is
insufficient to warrant a portion of the requested relief. As a result,
the Board recommends denial of so much of the application that pertains to
a change to the MOS listed in Item 23a (Specialty and Title) of his DD Form
214.

The applicant requests, in effect, correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show a duty military occupational specialty (MOS) of 11B (Infantryman). Although his DA Form 20 shows he was assigned to an MOS 11B duty position while he was in Korea, there is no evidence he was ever awarded MOS 11B. Evidence shows that at the time of his release from active duty on 24 October 1969 he held MOS "94B2O" which is currently reflected on his...

The applicant states his DD Form 214 shows in Item 30 (Remarks) that he was a cook in the RVN. A DA Form 20 in which item 22 (MOS) lists his primary MOS as 94B (Cook) with an effective date of 11 September 1970, and a secondary MOS as 11B (Infantryman) with an effective date of 21 October 1971. c. ARMY | BCMR | CY2010 | 20100028933
He states that he was never a cook and his MOS on his DD Form 214 should be changed to MOS 11B. Evidence of record shows that since being awarded primary MOS 94B, he performed duties as a cook up until his release from active duty. Therefore, MOS 94B is correctly entered on the applicant's DD Form 214.
ARMY | BCMR | CY2005 | 20050015798C070206
William F. Crain | |Member | The Board considered the following evidence: Exhibit A - Application for correction of military records. The applicant states that his MOS was 12A (Pioneer) not 94B (Cook) as recorded on his DD Form 214. This Form also shows he served in MOS 94B (Cook) from 31 May 1966 through the date of his separation.
ARMY | BCMR | CY2013 | 20130008108
The applicant states: * his DD Form 214 incorrectly lists his MOS as 94B (Cook) * he never served as a cook during his period of military service * his final MOS was 62E * he requests a DD Form 215 (Correction to DD Form 214, Certificate of Release or Discharge from Active Duty) to reflect this corrected MOS 3. Item 23a (Specialty Number and Title) of his DD Form 214 shows he held MOS 94B at the time of his release from active duty. Item 22 (MOS) of his DA Form 20 shows he held MOS 94B as...
ARMY | BCMR | CY2006 | 20060005880C070205
The applicant requests, in effect, that his military records be corrected to show military occupational specialty (MOS) 11B (gunner) instead of MOS 94B (cook). There is no evidence of record which shows the applicant was awarded MOS 11B. There is no evidence of record which shows he served in MOS 11B.
ARMY | BCMR | CY2011 | 20110005328
His DD Form 214 shows in: * item 23a his MOS as 94B * item 24 no award of the Combat Infantryman Badge. Based on Army Regulation 600-8-22, award of the Combat Infantryman Badge requires service in an infantry MOS in an infantry unit engaged in active ground combat with the enemy. Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.
