PART IV - PREHEARING REVIEW
SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. The evidence of record shows that the applicant was reported
AWOL, effective 13 October 1997 and DFR’d on 13 November 1997. On 12
December 1997, the applicant was apprehended by the civil authorities at
Russellville, AR and held pending return to military control. He was
subsequently transferred to the Personnel Control Facility (PCF) at Fort
Sill, OK for further processing. On 14 December 1997, the applicant again
departed AWOL and DFR’d on 13 January 1998. On 21 May 1998, he was
apprehended by the civil authorities at Cross Country, AR and again
transferred to the PCF at Fort Sill, Ok for processing. On 1 June 1998,
the applicant was charged with AWOL from 13 October – 12 December 1997 and
from 14 December 1997 – 21 May 1998. On 4 June 1998, the applicant
consulted with legal counsel and voluntarily requested, in writing,
discharge under the provisions of Chapter l0, AR 635-200 in lieu of trial
by court-martial. In this request, the applicant admitted guilt to the
offense, or a lesser-included offense. Further, the applicant indicated
that he understood that he could receive an under other than honorable
conditions discharge and that the discharge would have a significant effect
on eligibility for veteran’s benefits. The applicant did not submit a
statement in his own behalf. On 12 June 1998, the applicant was placed on
voluntary excess leave pending completion of his administrative discharge
proceeding under Chapter 10, AR 635-200. On 20 August 1998, the unit
commander recommended approval of an under other than honorable conditions
discharge. On 25 August 1998, the proper legal authority reviewed the
applicant’s request for discharge and found no legal objections to further
processing. On 26 August 1998, the separation authority approved the
discharge with an under other than honorable conditions discharge and
reduction to Private E1.
b. On 16 September 1998, the applicant was discharged. At the time
of discharge, the applicant had completed 8 months and 4 days of active
military service (which included 97 days of excess leave), and accrued 228
days of lost time in the period under review.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l0 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for a
discharge for the good of the service in lieu of trial by court-martial.
The requests may be submitted at any time after charges have been preferred
and must include the individual’s admission of guilt. Army policy states
that although an honorable or general discharge is authorized, a discharge
under other than honorable conditions is normally considered appropriate.

a. Propriety: The applicant has not submitted an issue of
propriety and the ADRB has not otherwise relied upon an
issue of propriety to change the discharge.

(1) The issue is rejected. The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
There was a full consideration of all faithful and honorable service as
well as the infractions of discipline, the extent thereof, and the
seriousness of the offenses. The Board noted the applicant’s contentions;
however, did not find said contentions sufficiently mitigating to warrant
an upgrade of the discharge under review. Further, the Board determined
that the applicant had many legitimate avenues through which to obtain
assistance or relief, without committing the serious misconduct, which led
to the separation action under review. The evidence of record shows the
applicant was charged with the commission of an offense punishable under
the Uniform Code of Military Justice (UCMJ) with a punitive discharge. The
Board noted, after consulting with defense counsel, the applicant
voluntarily, and in writing, requested separation from the Army in lieu of
trial by court-martial. In doing so, the applicant admitted guilt to the
stipulated or lesser-included offenses under the UCMJ. The Board was
satisfied that all requirements of law and regulation were met and the
rights of the applicant were fully protected throughout the separation
process. It also noted that the characterization of service for this type
of discharge is normally under other than honorable conditions and that the
applicant was aware of that prior to requesting discharge. The Board,
being convinced that the reason for discharge and the characterization of
service were both proper and equitable, voted to deny relief.
