PART IV - PREHEARING REVIEW
SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. The evidence of record shows that the applicant was reported
AWOL, effective 28 October 1996 and DFR’d on 27 November 1996. On 2
December 1996, the applicant surrendered to the military authorities at
Fort Huachuca, Arizona and was subsequently transferred to the Personnel
Control Facility (PCF) at Fort Sill, Oklahoma for further processing. On 6
December 1996, the applicant was charged with AWOL from 28 October – 2
December 1996. On 9 December 1996, the applicant consulted with legal
counsel and voluntarily requested, in writing, discharge under the
provisions of Chapter l0, AR 635-200 in lieu of trial by court-martial. In
this request, the applicant admitted guilt to the offense, or a lesser-
included offense. Further, the applicant indicated that she understood
that she could receive an under other than honorable conditions discharge
and that the discharge would have a significant effect on eligibility for
veteran’s benefits. The applicant did not submit a statement in her own
behalf. On 9 December 1996, the applicant was placed on excess leave
pending completion of her administrative discharge proceeding under Chapter
10, AR 635-200. On 3 February 1997, the unit commander recommended
approval of an under other than honorable conditions discharge. On 11
February 1997, the proper legal authority reviewed the applicant’s request
for discharge and found no legal objection for further processing. On 11
February 1997, the separation authority approved the discharge with an
under other than honorable conditions discharge and reduction to Private
E1.
b. On 3 March 1997, the applicant was discharged. At the time of
discharge, the applicant had completed 3 years and 1 month of active
military service (which included 85 days of excess leave), and accrued 33
days of lost time in the period under review.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l0 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for a
discharge for the good of the service in lieu of trial by court-martial.
The requests may be submitted at any time after charges have been preferred
and must include the individual’s admission of guilt. Army policy states
that although an honorable or general discharge is authorized, a discharge
under other than honorable conditions is normally considered appropriate.

(2) The issue is accepted. The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
There was a full consideration of all faithful and honorable service as
well as the infraction of discipline, the extent thereof, and the
seriousness of the offense. The Board does not condone the applicant’s
misconduct; however, determined that the characterization of service is now
inequitable. The Board found that the overall length and quality of her
service, her post-service accomplishments, the nature of the offense, and
the time that has elapsed since her discharge mitigated the applicant’s
misconduct. Accordingly, the Board voted to grant relief in the form of a
change to the characterization of service to fully honorable. The Board
was satisfied that the reason for discharge was proper and equitable, and
voted not to change it.
