                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  The evidence of record shows that the applicant was reported
AWOL, effective 14 October 1997 and DFR’d on 14 November 1997.  On 15
November 1997, the applicant surrendered to the military authorities at
Fort Benning, Georgia.  He was subsequently transferred to the Personnel
Control Facility (PCF) at Fort Knox, Kentucky for further processing.  On
20 November 1997, the applicant was charged with AWOL from 14 October – 15
November 1997.  On 20 November 1997, the applicant consulted with legal
counsel and voluntarily requested, in writing, discharge under the
provisions of Chapter l0, AR 635-200 in lieu of trial by court-martial.  In
this request, the applicant admitted guilt to the offense, or a lesser-
included offense.  Further, the applicant indicated that he understood that
he could receive an under other than honorable conditions discharge and
that the discharge would have a significant effect on eligibility for
veteran’s benefits.  The applicant did not submit a statement in his own
behalf.  On 20 November 1997, the applicant was placed on voluntary excess
leave pending completion of his administrative discharge proceeding under
Chapter 10, AR 635-200.  On 29 January 1998, the unit commander recommended
approval of an under other than honorable conditions discharge.  On 20
February 1998, the separation authority approved the discharge with an
under other than honorable conditions discharge and reduction to Private
E1.

      b.  On 17 March 1998, the applicant was discharged.  At the time of
discharge, the applicant had completed 2 years and 19 days of active
military service (which included 117 days of excess leave), and accrued 32
days of lost time in the period under review.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l0 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for a
discharge for the good of the service in lieu of trial by court-martial.
The requests may be submitted at any time after charges have been preferred
and must include the individual’s admission of guilt.  Army policy states
that although an honorable or general discharge is authorized, a discharge
under other than honorable conditions is normally considered appropriate.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infraction of discipline, the extent thereof, and the
seriousness of the offense.  The Board does not condone the applicant’s
misconduct; however, determined that the characterization of service is now
inequitable.  The Board found that the applicant’s misconduct was partially
mitigated by the overall length and quality of his service and his post-
service accomplishments.  Accordingly, the Board voted to grant partial
relief in the form of an upgrade of characterization of service to general,
under honorable conditions.  This action entails a restoration of grade to
E4.  The Board determined that the reason for discharge was proper and
equitable and voted not to change it.

        (1)  The issue is rejected.  By his misconduct, the applicant
diminished the quality of service below that meriting a fully honorable
discharge.  See response to issue (2) above.
