PART IV - PREHEARING REVIEW
SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. Evidence of record shows that on 7 October 2003, the unit
commander notified the applicant of initiation of separation action under
the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory
performance, with a general, under honorable conditions discharge. The
reasons for the proposed action were she received a Company Grade Article
15 for failure to report. She had also been counseled on numerous
occasions for other misconduct, to include failure to report, disobeying a
lawful order, and failure to pay debts. She was advised of her rights. On
7 October 2003, the applicant was advised of the impact of the discharge
action, waived her right to consult with legal counsel, and did not submit
a statement in her own behalf. The unit commander recommended separation
from the service and waiver of further rehabilitative efforts. The
intermediate commander reviewed the proposed discharge action and
recommended approval of the separation action with a general discharge. On
20 October 2003, the separation authority waived further rehabilitative
efforts and directed that the applicant be discharged with a
characterization of service of general, under honorable conditions.
b. On 31 October 2003, the applicant was discharged. At the time of
discharge, the applicant had completed 2 years, 4 months, and 12 days of
active military service in the period under review.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 13 contains the policy and outlines the procedures for separating
individuals for unsatisfactory performance, and provides, in pertinent
part, that commanders will separate a member under this chapter when, in
the commander's judgment, the member will not develop sufficiently to
participate satisfactorily in further training and/or become a satisfactory
soldier. Army policy states that a general discharge, under honorable
conditions is normally considered appropriate, but an honorable discharge
may be granted in meritorious cases.

applicant’s record of service during the period of enlistment under review.
There was a full consideration of all faithful and honorable service as
well as the incidents of unsatisfactory performance, the extent thereof,
and the seriousness of the incidents. The Board does not condone the
applicant’s incidents of unsatisfactory performance; however, determined
that the characterization of service is inequitable. The Board found that
the applicant's generally acceptable personal conduct and performance of
duty mitigated the discrediting entries in her service record.
Accordingly, the Board voted to grant relief in the form of an upgrade of
characterization of service to fully honorable. The Board determined that
the reason for discharge was both proper and equitable and voted not to
change it.
