                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 7 February 1994, the unit
commander notified the applicant of initiation of separation action under
the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory
performance, with a general, under honorable conditions discharge.  The
reasons for the proposed separation action were her demonstrated
unsatisfactory performance even after formal counseling and that she had
not developed sufficiently to become a satisfactory soldier.  Incidents
included failure to go and dereliction of duty for which she received a
company grade Article 15, disobeying a lawful order from her command, and
disrespect to a noncommissioned officer.  She was advised of her rights.
On 7 February 1994, the applicant consulted with legal counsel, was advised
of the impact of the discharge action, and did not submit a statement in
her own behalf.  The unit commander subsequently recommended separation
from the service and waiver of further rehabilitative efforts.  On 9
February 1994, the separation authority waived further rehabilitative
efforts and directed that the applicant be released from active duty with a
characterization of service of general, under honorable conditions and
transferred to the Individual Ready Reserve to complete the remainder of
her statutory military obligation.

      b.  On 15 February 1994, the applicant was released from active duty
and transferred to the USAR Control Group (Annual Training), ARPERCEN, St
Louis, Missouri.  At the time of release, the applicant had completed 1
year, 7 months, and 7 days of active military service in the period under
review.  On 16 May 2000, the applicant was honorably discharged from the
Reserve of the Army.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 13 contains the policy and outlines the procedures for separating
individuals for unsatisfactory performance, to include separation for those
individuals who fail to maintain Army physical standards.  Initiation of
separation proceedings is required for individuals without medical
limitations who have two consecutive failures of the Army physical fitness
test or who are eliminated for cause from Noncommissioned Officer Education
System courses unless the responsible commander chooses to impose a bar to
reenlistment per AR 601-280.  Service of individuals separated because of
unsatisfactory performance will be characterized as honorable or under
honorable conditions as warranted by their military records.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the incidents of unsatisfactory performance.  The Board does not
condone the applicant’s unsatisfactory performance; however, determined
that the characterization of her service is now inequitable.  The Board
found that the applicant’s unsatisfactory performance was mitigated by her
diagnosed personality disorder; her subsequent honorable discharge from the
Reserve of the Army; and the time that has elapsed since her release from
active duty.  Accordingly, the Board voted to grant relief in the form of
an upgrade of characterization of service to fully honorable.  The Board
determined that the reason for discharge was proper and equitable and voted
not to change it.
