PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 14 December 1989, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance, with a general, under honorable conditions discharge. She was advised of her rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, and did not submit a statement in her behalf. The unit commander subsequently recommended separation from the service, and waiver of further rehabilitative efforts. On 4 January 1990, the separation authority waived further rehabilitative efforts and directed that the applicant be transferred to the Individual Ready Reserve with service characterized as general, under honorable conditions.

         b. On 9 January 1990, the applicant was discharged with a general, under honorable conditions discharge. At the time of discharge, the applicant had
1 year, 1 month, and 10 days service on her current enlistment.

         c. The unit commander recommended the applicant be separated because she had demonstrated that she was not qualified for retention in the US Army. He further stated that her unsatisfactory drop from the academic portion of Advanced Individual Training Course, her on and off enrollment in the Army Weight Control Program, her being overweight now, and her overall performance and attitude as a soldier did not warrant giving her a second training opportunity.

2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

(2) The issue is accepted. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The evidence of record shows that the applicant was discharged under the provisions of Chapter 13, AR 635-200, by reason of unsatisfactory performance with a general, under honorable conditions discharge. The basis for the applicant’s unsatisfactory performance was her failure to maintain academic and Army weight control standards. The Board determined that the minor infractions of discipline documented in the applicant’s record did not diminish the quality of her service below fully honorable. Accordingly, the Board voted to grant relief by changing the characterization of service to honorable. The Board found that the reason for discharge was proper and equitable and voted not to change it.
