                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  The evidence of record shows that on 10 January 2002, the unit
commander initiated separation action under the provisions of Chapter 7, AR
635-200, by reason of fraudulent entry in that the applicant attained a
fraudulent work visa, which allowed him to unlawfully enlist into the
United States Army.  On 16 January 2002, the applicant consulted with legal
counsel, was advised of the impact of the discharge action, and submitted a
statement in his own behalf.  On 16 January 2002, the unit commander
subsequently recommended separation from the service with an honorable
discharge.  On 24 January 2002, the intermediate commander reviewed the
proposed discharge action and recommended approval of the separation action
with an honorable discharge.  The proper legal authority reviewed the
discharge action with no legal objections for continued processing.  On 25
January 2002, the separation authority approved the discharge and directed
that the applicant be discharged with a characterization of service of
honorable.

      b.  On 18 February 2002, the applicant was discharged.  At the time
of discharge, the applicant had completed 2 years, 10 month, and 10 days of
active military service in the period under review.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 7 of that regulation provides, in pertinent part, that a fraudulent
entry is the procurement of an enlistment, reenlistment, or period of
active service through any deliberate material misrepresentation, omission,
or concealment of information which if known and considered by the Army at
the time of enlistment or reenlistment, might have resulted in rejection,
including all disqualifying information requiring a waiver.  This also
includes misrepresentation of intent with regard to legal custody of
children.  Soldiers separated under this chapter may be awarded an
honorable discharge, or a general discharge, or a discharge under other
than honorable conditions.  If in an entry level status the
characterization will be uncharacterized.

issues of propriety and/or equity:

      a.  Propriety:   The parenthetical number(s) below correspond(s) to
                   the issue number(s) on the DD Form 293, or in Part VI,

        (1)  The issue is rejected.  The evidence of record show that the
applicant was properly processed for separation under the provisions of
Chapter 7, AR 635-200, by reason of fraudulent entry with a
characterization of service of honorable.  The Board found no evidence of
racial discrimination on the part of the applicant’s chain of command.
Further, a change to reentry eligibility (RE) codes does not fall within
the purview of this Board.  If the applicant desires to reenlist, he should
contact the local recruiter to determine his current eligibility to
reenlist.  Those individuals can best advise a former service member as to
the needs of the Army at the time, and are required to process waivers of
RE codes.  See response to issue (2) below.

      b.  Equity:      The parenthetical number(s) below correspond(s) to
                   the issue number(s) on the DD Form 293, or in Part VI,
                   Paragraph 1, above.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review
and heard his testimony.  There was a full consideration of all faithful
and honorable service as well as the infraction of discipline, the extent
thereof, and the seriousness of the offense.  Notwithstanding the propriety
of the applicant’s discharge, the Board determined that the narrative
reason for separation is now inequitable.  The Board concluded that the
applicant’s length and quality of his service and the circumstances
surrounding his enlistment in the Army mitigated the narrative reason for
his separation.  Accordingly, the Board voted to grant partial relief and
to change the narrative reason for separation to Secretarial Authority.
