PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 23 April 1992, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance, with an honorable discharge. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, and submitted a statement in his own behalf. The unit commander subsequently recommended separation from the service. On 5 May 1992, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a characterization of service of honorable conditions.

         b. On 19 May 1992, the applicant was discharged. At the time of discharge, the applicant had completed 3 years, 2 months, and 19 days of active military service.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

(1) The issue is accepted. The Board carefully examined the applicant’s record of service during the period of enlistment under review.
The Board noted that the applicant was separated from the Army under the provisions of Chapter 13, AR 635-200, by reason of unsatisfactory performance because he failed to attain a passing score on the Army Physical Fitness Test. However, it appears from the evidence in the official record that the applicant never failed three consecutive PT tests, a requirement in order to discharge the applicant on the basis of PT failure. Given the above, the Board found that the narrative reason for discharge was improper. Accordingly, the Board voted to grant relief by changing the applicant’s narrative reason for discharge to Secretarial Authority. This action includes a change in RE code to 1.

         b. Equity:       The applicant has not submitted an issue of equity and the ADRB has not otherwise relied upon an issue of equity to change the discharge. The major factors upon which the discharge was based are set forth in Parts III and IV of this decisional document.
