PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 9 November 1999, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance, with an honorable discharge. She was advised of her rights. The applicant waived legal counsel, was advised of the impact of the discharge action, and did not submit a statement in her own behalf. The unit commander subsequently recommended approval of the discharge action and forwarded it through command channels to the separation authority. On 10 November 1999, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with an honorable discharge.

         b. On 16 November 1999, the applicant was discharged. At the time of discharge, the applicant had 6 months, and 17 days on her current enlistment.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

(3) The issue is accepted. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The Board noted that the applicant’s discharge from the Army was approved as honorable. However, someone in the discharge process inadvertently changed it to uncharacterized. In view of the foregoing, the Board voted to change the applicant’s characterization of service to honorable as approved by the separating authority.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(2) The issue is accepted. The record indicates that the separating authority recommended and approved the applicant’s separation under the provisions of AR 635-200, Chapter 13, by reason of unsatisfactory performance instead of paragraph 14-12c(1) as shown on the applicant’s DD Form 214. In accordance with AR 635-5, the Separation Program Designator (SPD) Code for unsatisfactory performance should be “JHJ” with a Reenlistment Code of RE3. Accordingly, the administrative error will be corrected to reflect the appropriate separation authority and SPD Code. This administrative correction does not entail a change to the RE Code as RE3 is currently reflected on the applicant’s DD Form 214.
