PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 28 April 1999, the unit commander recommended separation from the Army. On 4 May 1999, Orders 124-1319, DA, HQ, US Army Training Center and Fort Jackson, SC, discharged the applicant from the Regular Army, effective date: 6 May 1999. The specific facts and circumstances leading to the applicant’s discharge are not contained in the available records.
The applicant refused to sign his DD Form 214 (Certificate of Release or Discharge from Active Duty). His DD Form 214 indicates that he was discharged under the provisions of Chapter l3, AR 635-200, for unsatisfactory performance, with a general discharge (GD).

         b. On 6 May 1999, the applicant was discharged with a general, under honorable conditions discharge, under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance. At the time of discharge, the applicant had 4 months, and 9 days on his current enlistment.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

(7) The issue is accepted. The Board having found that the command initiated separation under the provisions of chapter 13 AR 635-200 while the applicant was in an entry-level status determined the discharge to be improper. The regulation required the command to separate the applicant under the provisions of chapter 11, AR 635-200. Accordingly, the Board voted to grant full relief in the form of an honorable discharge by reason of secretarial authority. This action does not entail a change in the reentry eligibility (RE) code.
