PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

a. The applicant’s record is void of facts and circumstances concerning events that led to a discharge from the Army. The Board noted that the applicant’s record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant. This document identifies the reason and characterization of the discharge as general, under honorable conditions, under the provisions of Chapter 5-18, AR 635-200, by reason of physical condition, not a disability with an SPD Code of LFV. On 4 June 1999, Department of the Army; Headquarters, I Corps, Military Personnel Division, Fort Lewis WA, Orders 155-0014 released the applicant from active duty and assigned him to the USAR CRTLGP (ANLTNG) ARPERCEN, St. Louis MO.

         b. On 8 June 1999, the applicant was released from active duty. At the time of discharge, the applicant had 1 year, and 12 days service on his current enlistment under review.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 provides the basic authority for the separation of enlisted personnel. Paragraph 5-18 provides that a soldier has a physical or mental condition that potentially interferes with assignment to or performance of duty, the commander will refer that soldier for a medical examination and/or mental status evaluation in accordance with AR 40-501, and excluding conditions appropriate for separation processing under paragraphs 5-11 or 5-13.

(1) The issue is accepted. The Board carefully examined the applicant’s available records for the period of enlistment under review. The Board noted that the applicant was discharged under the provisions of Chapter 5, AR 635-200, for a physical condition, not a disability. There is no evidence of misconduct in the available record. Accordingly, the Board determined that the applicant’s characterization of service was inequitable and voted to grant relief in the form of an upgrade of characterization of service to fully honorable. In the absence of evidence to the contrary, the Board presumed administrative regularity in the narrative reason for discharge and voted not to change it.
