                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 15 November 2001, the applicant
was placed in pre-trial confinement for the suspected violations of absence
without leave (AWOL)(2-6 November 2001); wrongfully using marijuana (3
September 2001); and wrongfully possessing approximately 6 grams of
marijuana (3 October 2001).  On 15 November 2001 he was officially charged
with the above charges and specifications.   On 21 November 2001, the
applicant voluntarily tendered his resignation from the service under the
provisions of Chapter 3, Paragraph 3-13, AR 600-8-24, resignation for the
good of the service in lieu of trial by a court-martial.  The chain of
command recommended approval of the resignation for the good of the service
with issuance of an under other than honorable conditions discharge.  On 11
January 2002, the Deputy Assistant Secretary (Army Review Boards) reviewed
the Resignation for the Good of the Service in Lieu of General Court-
Martial tendered by the applicant, accepted his resignation, and directed
that he be discharged with a characterization of service of under other
than honorable conditions.

      b.  On 25 January 2002, the applicant was discharged.  At the time of
discharge, the applicant had completed 1 year, 4 months, and 12 days of
active military service and accrued 4 days of lost time in the period under
review.  He had a total of 11 years, 5 months, and 10 days of total
military service.

2.  Legal/Regulatory Basis for Separation Action:  Army regulation 600-8-24
prescribes the policies and procedures governing the transfer and discharge
of Army officer personnel.  Chapter 3, Paragraph 3-13 outlines the rules
for processing request for resignation for the good of the service in lieu
of trial by a general court-martial.

      a.  Propriety:   The applicant has not submitted an issue of
                   propriety and the ADRB has not otherwise relied upon an
                   issue of propriety to change the discharge.

                   Paragraph 1, above.

        (1)  The issue is rejected.  The Board carefully examined the
applicant’s record of service for the period under review.  There was a
full consideration of all faithful and honorable service as well as the
infractions of discipline, the extent thereof, and the seriousness of the
offenses.  The evidence of record does not support the applicant’s
contentions and the applicant has provided no independent corroborating
evidence in support of his contentions.  Further, the Board found no
evidence of racial discrimination and or arbitrary and capricious action on
the part of the applicant’s chain of command.  The Board determined that
the applicant’s discharge was appropriate because the quality of his
service was not consistent with the Army's standards for acceptable
personal conduct and performance of duty by military personnel.  By his
misconduct and poor duty performance, the applicant diminished the quality
of his service below that meriting a fully honorable or general discharge.
The Board, being convinced that the reason for discharge and the
characterization of service were both proper and equitable, voted to deny
relief.
