PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

          a. The evidence of record shows that the applicant was charged with wrongfully using marijuana. On 12 February 1998, the appropriate authority recommended approval of the applicant’s request for resignation for the good of the service-in lieu of general court-martial with an under other than honorable conditions discharge. On 9 March 1998, the majority of the Army Ad Hoc Review Board recommended that the applicant’s resignation be accepted with issuance of a general, under honorable conditions discharge. On 11 March 1998, the Deputy Assistant Secretary (Army Review Boards) approved the recommendation of the majority of the Army Ad Hoc Review Board and directed that the applicant be discharged with a general, under honorable conditions discharge.

         b. On 8 April 1998, the applicant was discharged. He was credited with
4 years and 21 days of active service.

2. Legal/Regulatory Basis for Separation Action : Army regulation 600-8-24 prescribes the policies and procedures governing the transfer and discharge of Army officer personnel. Chapter 3, Paragraph 3-13 outlines the rules for processing request for resignation for the good of the Service in lieu of trial by a general court-martial.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.
         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

 (1) The issue is rejected. The Board carefully examined the applicant’s record of service. There was a full consideration of all faithful and honorable service as well as the infraction of discipline, the extent thereof, and the seriousness of the offense. The applicant, by violating the Army's policy not to possess or use illegal drugs, compromised the special trust and confidence placed in him as a commissioned officer. The applicant, as a commissioned officer, had the duty to support and abide by the Army's drug policies. By abusing illegal drugs, the applicant knowingly risked a military career and diminished the quality of his service below that meriting a fully honorable discharge. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
