PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 15 April 1998, the appropriate authority notified the applicant of initiation of separation action under the provisions of Chapter 4, AR 600-8-24 with an under other than honorable conditions. On 31 August 1998, the applicant voluntarily tendered his resignation from the Army under the provisions of Chapter 4, AR 600-8-24 in lieu of elimination and was advised of the impact of the discharge action. On
9 November 1998, Ad Hoc Review Board recommended that the applicant’s resignation be accepted with issuance of an under other than honorable conditions discharge. On 16 November 1998, the Deputy Assistant Secretary (Army Review Boards) approved the recommendation of the Army Ad Hoc Review Board and directed that the applicant be discharged with an under other than honorable conditions.

         b. On 1 December 1998, the applicant was discharged. He was credited with
4 years, 9 months, and 17 days active service during the period of service under review.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 600-8-24 sets for the basic authority for Officer transfers and discharges. Chapter 4 outlines the policy and procedure for the eliminating officer from the active Army for substandard performance of duty, misconduct, moral or professional dereliction, and the interest of national security.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

(1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of service under review and heard his testimony. After giving full consideration of all faithful and honorable service as well as the infractions of discipline, the Board determined that the applicant’s discharge was appropriate because the quality of service was not consistent with the Army’s standards for acceptable personal conduct by an officer. The Board noted the applicant’s contentions, however, the applicant provided no independent corroborating evidence demonstrating that either the command’s action was erroneous or the result of racial bias. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
