PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 29 September 1998, the applicant was charged with conspiracy to obstruct justice; obstruction of justice; making a false official statement; and unlawful detention. On 9 November 1998, the applicant voluntarily tendered her resignation from the Army under the provisions of Chapter 3, AR 600-8-24, for the good of the Service in lieu of a general court-martial. On 23 November 1998, an additional charge of dereliction of duty was levied against the applicant. Her entire chain of command recommended disapproval of her request for discharge pending final disposition of an on-going court-martial. On 12 March 1999, the Deputy Assistant Secretary (Army Review Boards) approved the recommendation of the Army Ad Hoc Review Board and directed that the applicant be discharged with an under other than honorable conditions.

         b. On 15 March 1999, the applicant was discharged. She was credited with
1 year, 9 months, and 15 days active military service for the term of service under review.

Legal/Regulatory Basis for Separation Action : Army regulation 600-8-24 prescribes the policies and procedures governing the transfer and discharge of Army officer personnel. Chapter 3, Paragraph 3-13 outlines the rules for processing request for resignation for the good of the Service in lieu of trial by a general court-martial.
